from Mr. Mortach regarding the matter of a fence being installed was given to the applicant and <br />would be looked into and discussed at the follow-up meeting. Mr. Yager noted that there was <br />sections of existing fences on neighboring properties and questioned their existence. <br />J. Lasko moved to table the proposal for Nissan of North Olmsted at 28500 Lorain Road <br />which consists of facade renovations & sfgnage requesting that the applicant submit <br />revised plans. R. Bohlmann seconded the motion, which was unanimously approved. <br />VI. COMMUNICATIONS: <br />Ordinance: 2006-135 <br />An ordinance creating new chapter 1142 (Residential Office District) of the North Olmsted <br />Zoning Code in order to establish a new district of permitted uses. <br />Ms. Wenger reviewed land use recommendations of the 2005 Master Plan, including specific <br />recommendations for the west end focus area, encompassing the Barton/Bradley triangle area. <br />The area is currently zoned light industrial, and the Plan recommends some type of residential <br />use in the area. Since the Plan's update she has been working with the zoning advisory <br />committee for possible solutions/updates to all zoning districts, but in particular the triangle area. <br />She told the Commission members that if the legislation was approved it would create a new <br />zoning district only, and would not rezone any land/parcels in the city at this time. However the <br />next step would then be identifying appropriate areas which should be zoned Residential Office <br />District and then proceed through legislative action to rezone those properties. <br />The concept of a Residential Office District came about through acting on concerns voiced by <br />both council and residents who live and own property within the triangle area as well as viewing <br />the current uses of the area. To rezone tlie area strictly residential would challenge existing <br />businesses which were developed under current zoning requirements. Reviewing the triangle <br />area also showed that there was a high volume of residential homes, home offices, small <br />businesses, government uses, parlcs & recreation and a very limited number of industrial uses. <br />She believes that creating the new zoning district would provide an area to transition between <br />residential neighborhoods and more intense uses, while reflecting many of the uses currently in <br />the area. The provisions within the new district would ensure the residential character of the area <br />would be maintained. <br />Mr. Conway advised that the Building Department was in favor of the proposed zoning district <br />as it is presented. Mr. Raig advised that the creation of the district was good for the city however <br />the maximum slope for landscape mounds of 3:1 would limit the amount of area which could be <br />developed and suggested modifying the maximum slope requirement. <br />Mr. O'Malley advised that creating the district and rezoning areas into the newly created district <br />places restrictions on existing private property owners. Government exercises authority based on <br />solid foundations in planning principals such as master plans which are intended to forecast what <br />type of land uses are appropriate which form the foundation for a reasonable non-arbitrary <br />exercise of government regulations. The proposed ordinance is the nuts & bolts of what uses are <br />permitted, what uses would be conditional, and some of the regulations which will ensure <br />specific objectives are met within the district as listed within the ordinance. The ordinance is <br />one of many pieces of legislation which will go before the Commission to implement or carry <br />out the master plan objectives. <br />Mr. Bohlmann asked if cluster housing which has been proposed or assisted living would be a <br />permitted uses in the triangle area if the ordinance is adopted and area rezoned.
