CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />HELD IN COUNCIL CHAMBERS <br />APRIL 6, 2006 <br />MINUTES <br />I. ROLL CALL: <br />Chairman 1Vlaloney called the meeting to order at 7:35 pm. <br />• PRESENT: Members: J. Maloney, M. Diver, J. Burke and T. Kelly <br />AI,SO 1'RESEloT'I': Assistant Law Director B. O'Malley, Building Commissioner D. Conway, <br />and Clerk of Commissions D. Rote. <br />ABSENT: Member N. Sergi (on maternity leave) <br />Chairman Maloney reviewed that there were 10 cases requesting 38 variances on the docket. He <br />further advised that each board member had viewed the premises involved for each case. Three <br />votes are required for approval and in addition, each case would be judged on the physical <br />situation peculiar to itself, so that in no way is a judgment rendered considered to be a general <br />policy judgment affecting properties and like situations elsewhere. <br />Chairman Maloney announced that both Tuesday Morning and Macy's submitted written <br />requests to postpone their cases until the May 4, 2006 BZA meeting. <br />J. Burlce moved to postpone Tuesday Morning and Macy's variance requests until the May <br />4, 2006 BZA meeting. M. Diver seconded the anotion, which was unanimously approved. <br />1. REVIEW AND CORRECTION OF MINUTES: <br />M. Diver moved to approve the Board of Zoning Appeals minutes dated March 2, 2006, as <br />written. J. Burke seconded the motion, which was unanimously approved. <br />1. RESIDENTIAL APPEALS AND REQUESTS: <br />1. John & Joan Reindle; 5014 West Park: (WRD # 1) <br />Request for variance (1123.12). The proposal consists of a new storage shed. <br />The following variance is required: <br />1). A 48 square foot variance for an accessory storage building, larger than code allows, (code <br />pennits 120 sq ft, applicant shows 168 sq ft). <br />Which is in violation of Ord. 90-125 section (1135.02 (D1)). <br />Mr. Reindle the owner came forward to be sworn in and address his request. Mr. Reindle <br />reviewed that he would be replacing the existing shed which had been in place for more than 20 <br />years. However the new shed will be 2-feet wider to accommodate additional items requiring <br />storage. He. believed that his homes rear addition created the need for the variance as the square <br />footage is calculated off the rear of the addition not the main house. Therefore there is a large <br />area which is not used for calculating the square footage. Mrs. Diver believed that the yard was <br />large enough to handle the shed. <br />M. Diver moved to grant John & Joan Reindle of 5014, West Park their request for <br />variance (1123.12), which consists of a new storage shed and that the following variance is <br />granted: <br />1
