4. A variance for 2 additional ground signs, (code permits 1, applicant shows 3), section <br />(1163.26 (A)): <br />5. A variance for ground signs too close together, (code requires 200', applicant shows less than <br />200'), section (1163.26 (A)). <br />Which is in violation of Ord. 90-125 sections (1139.09), (1161.05 (r)), (1161.12 (e)) and <br />(1163.26 (A)). Note: Planning & Design Commission approved landbanking 4 parking spaces. <br />Mr. Kilgore applicants representative came forward to be sworn in and address the request. Mr. <br />Kilgore indicated that the business is a quick serve facility and the proposed site also houses the <br />Conrad's builcling. The 7 foot front yard setback variance is for traffic flow and patterns around <br />the building. The new building will also be bloclced by the existing Conrad's building as it sits <br />closer to the sidewalk. A thirteen parking space variance is needed as there will be 60 actual <br />parking spaces, 4 landbanked spaces and to provide additional landscape they have requested the <br />variance for remaining 13 spaces required. Variance pertaining to light mounting heights near <br />residential property lines will have full cut-offs and are a 90 degree fixture. He presented a <br />photo of the rear of the site and reviewed that the light in question is to illuminate the dumpster <br />enclosure to 'protect worlcers during evening hours. Last two variances are for ground signs one <br />of which is a pre menu board and the other is the actual menu board where orders are taken. The <br />pre menu board is located within 200 feet of the menu board to assist patrons is placing orders in <br />a timely manor. <br />Mr. Burlce aslced the Building Commissioners opinion regarding parking. Mr. Conway advised <br />that the parlcing spaces are related to the outdoor seasonal area which requires an additional 10 <br />parking spaces. The applicants believe that the 60 spaces will meet their needs and city parking <br />requirements are a little strong when addressing drive through restaurants. He believes that the <br />number of parking spaces provided would be sufficient to handle the proposed use. <br />J. Maloney moved to grant Chick-Fil-A of 4777 Great Northern Blvd. their request for <br />variance (1123.12), which consists of a new free standing restaurant, site improvements and <br />that the following variances are granted: <br />1. A 7 foot variance foa- builcling front yard setback, (code requires 75', applicant show <br />681), section (1139.09). <br />2. A variance for 13 car parking (see note), (code requires 77, applicant show 60), section <br />(1161.05 (r)). <br />3. A 24 foot variance for distance of luminary mounting height from residential property <br />line, (code requires 1151, applicant shows 91', section (1161.12 (e)). <br />4. A variance for 2 additional ground signs, (code permits 1, applicant shows 3), section <br />(1163.26 (A)). <br />5. A variance for ground signs too close together, (code requires 200', applicant shows less <br />than 2001), section (1163.26 (A)). Which is in violation of Ord. 90-125 sections (1139.09), <br />(1161.05 (r)), (1161.12 (e)) and (1163.26 (A)). T. Kelly seconded the motion, roll call on <br />the motion; T. Kelly, M. Diver, J. Maloney, yes, and J. Burke no to request #2 and yes to all <br />other requests. Variances Approved. <br />5. Wellington Place; 4800 Cla2ue Road: (WRD # 4) <br />Request for variance (1123.12). The proposal consists of a new wing to existing structure & site <br />modifications. The following variances are required: . <br />1. A variance for not having full cut off fixtures, (code requires all, applicant shows norie), <br />section (1161.12 (d)). <br />2. A 4 foot 9 inch variance for side yard setback, (code requires 54'9", applicant shows 50'), <br />section (1138.05 (d)). <br />7
