Sergi felt that the board should stick by their ruling they gave the applicant many opportunities to <br />address variances and it is quite clear that a special permit is only to be granted if variances are not <br />required. All board members agreed that the request to reconsider was not substantiated What the <br />board has been presented still requires area variances which is not new. The board felt that diligent <br />time and meetings were provided to the applicant to address her issues. <br />N. Sergi moved to grant Joseph and Vicki Mate of 23281 Marion Road their request for <br />reconsideration from their variances. T. Kelly seconded the motion which was unanimously <br />denied. <br />N. Sergi moved to adopt the Board of Zoning Appeals findings pertaining to Joseph and Vicki <br />Mate of 23281 Marion Road as submitted by the Assistant Law Director. J. Maloney seconded <br />the motion which was unanimously approved. <br />J. Burke moved to adopt the Board of Zoning Appeals findings pertaining to Dale & Pamela <br />Masola; 27649 Marquette Blvd as submitted by the Assistant Law Director. N. Sergi seconded <br />the motion which was unanimously approved. <br />• Accept or modify proposed calendar for 2007 Boaxd of Zoning Appeals meetings. <br />N. Sergi moved to adopt the proposed 2007 meeting calendar as submitted. J. Burke seconded <br />the motion which was unanimously approved. <br />The clerk was asked to include choosing a chair and vice chair on the January docket. <br />Mrs. Diver thanked Mr. Maloney for his years of service to the board and city of North Olmsted. <br />Board members reluctantly accepted Mr. Maloney's letter advising he was retiring after 16 years of <br />serving on the Boaxd of Zoning Appeals and reviewed the Mayors proclamation to Mr. Maloney. <br />Mr. Maloney thanked Assistant Building Commissioner Tom Rymarczyk for his years of service <br />supporting the Board of Zoning Appeals and wished him well in his retirement. <br />Mr. Kalina asked to address the board and questioned if the board intended to not grant the service <br />sign and asked if they wanted to reconsider the motion for the number of wall signs. Board <br />members advised that they did not wish to reconsider their motion. <br />Mr. Masloa ask for clarification as to what was granted. Mr. O'Malley advised that the applicant <br />was granted a 17-foot variance for the placement of the fence, November 2, minutes were adopted <br />and the November 2, 2006 findings were adopted. Therefore the applicant has a right to appeal the <br />boards final decision through the courts or may chose to make a new application pertaining to the <br />height and fence percentage open they are required to reduce a minimum of 25%. <br />VI.
