CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />COUNCIL CHAMBERS <br />AUGUST 3, 2006 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:40 pm <br />PRESENT: J. Maloney, J. Burke, M. Diver, N. Sergi, T. Kelly <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczyk and Planning Secretary S. English. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />M. Diver moved to adopt the Board of Zoning Appeals minutes of June 1, 2006, as written. J. Burke <br />seconded the motion, which was unanimously approved. <br />III. RESIDENTIAL APPEALS AND REQUESTS: <br />1. Pam Zimmerman; 4942 Grace Road: (WRD # 4) <br />Request for variance. The proposal consists of a new porch. The following variance is requested: <br />1. A 10 foot variance for a residence too close to right-of-way, (code requires 50', applicant shows <br />40'), which is in violation of section 1135.06(a). <br />Ms. Zimmerman the owner came forward to be sworn iri and address her request. Ms. Zimmerman <br />wants to build a front porch, 10x18 with a roof. The house sits back 50 feet and the porch would <br />extend into the setback; therefore, she needs a 10 foot variance. The neighbors have no concerns. <br />Mrs. Diver did not see any problems with the request. The home has been there 50 years. Mrs. <br />Sergi questioned why she would like a roof on the porch, which Ms. Zimmerman articulated its <br />functionality should it rain. The dimensions will extend from the picture window on one side to the <br />window on the other side, 10 feet out. The current porch can have only two chairs. <br />M. Diver moved to grant Pam Zimmerman of 4942 Grace Road her request for variance, <br />which consists of: 1. A 10 foot variance for a residence too close to right of way, (code requires <br />501, applicant shows 40'), which is in violation of 1135.06(a). T. Kelly seconded the motion, <br />which was unanimously approved. Variance Granted <br />2. Marv Karcher; 23095 Vir2inia Ave: (WRD # 2) <br />Request for variance. The proposal consists of a home addition. The following variance is <br />requested: <br />1. A 5 foot variance for a residence too close to a detached garage, (code requires 15', applicant <br />shows 10'), which is in violation of 1135.02(C)(2). <br />Ms. Karcher the owner came forward to be sworn in and address the request.. Ms. Karcher would <br />like to put a family room on the back of her house, which will.make the house too close to the <br />detached garage. Mrs. Diver questioned how much farther back her home would be than her <br />neighbor's garage, which is about 3-5 feet farther out. Mr. Rymarczyk said that they would have to <br />fire rate that portion within the 15 feet. Ms. Karcher said they are willing to do that to the garage. <br />She will build it to meet the code. Mrs. Sergi asked if the whole wall or just the corner is too close; <br />it was just the corner. Mrs. Sergi questioned whether it will be an issue getting in and out. Ms. <br />Karcher pointed out the distance of back of house is 25 feet, she is only going 22 feet. Mr. Maloney <br />has no problem as long as it meets the code. J. Maloney moved to grant Mary Karcher of 23095 Virginia Ave her request for variance, <br />which consists of: 1. A 5 foot variance for a residence too close to a detached garage, (code <br />requires 151, applicant shows 10'), which is in violation of 1135.02(C)(2), with the amendment
