CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />HELD IN COUNCIL CHAlVIBERS <br />JUNE 29, 2006 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:40.pm <br />PI2ESENT: Meinbers; J. Maloney, J. Burlce, M. Diver and N. Sergi. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczylc and Clerlc of Commissions D. Rote. <br />ASSENT: Member; Terence Kelly <br />II. REVIEW AND CORRECTION OF MINUTES: <br />J. Btulce moved to adopt the Board of Zoning Appeals minutes dated June 1, 2006, as written. M. <br />Diver seconded the inotion, which was unanimously approved. <br />Chaiiā¢man Maloney reviewed that there were 8 cases requesting 18 variances and 1 special permit on <br />the doclcet. He fiirther advised that each board member had viewed the premises involved for each <br />case. Three votes are required for approval and in addition, each case would be judged on the <br />physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a <br />general policy judginent affecting properties and lilce situations elsewhere. <br />III. RESIDENTIAL APPEALS AND REQUESTS: <br />1. Gary Normand; 6427 McKenzie Road: (WRD # 3) <br />Request for variance (1123.12). The proposal consists of a new garage. <br />The following variance is requested: <br />1. A 2,134 square foot variance for coinbined garage space total on a lot, (code permits 750 sq ft, <br />applicant shows 2,884 sq ft). <br />Which is in violation of Ord. 90-125 section; (1135.02 (c)). <br />Note: Total garage space includes exiting (22' x 22' (484 sq ft)) garage and proposed additional <br />garage (2,400 sq ft), plan shows a blaclctop driveway to be constructed if approved. <br />Mr. Normand the owner, Mr. Normand Sr., Mr. Totten, Ms. Geye, and Mr. Butra, neighbors each of <br />which came forward to be sworn in and address the request. Mr. Normand reviewed that he restores <br />antique cars and he would lilce a place to store his cars. He purchased his home with the intent to be <br />able to store his family's vehicles. He met with the City to find out if he would be allowed to erect a <br />garage and was told if he had enough land he could build a garage. Mr. Totten advised that he abuts <br />the applicants and voiced that the variance being requested is substantial, the character of the <br />neighborhood would be substantially altered, the owner can rent a storage unit off site, the spirit & <br />intent of the code would not be observed if granted the variance and he does not feel he should have <br />to loolc at a commercial building next to his baclcyard. He is not opposed to having a garage but he <br />is apposed to the size and location. He suggested the garage could be relocated and not so large. He <br />presented photos of what the area loolcs like now and what it would loolc like once the building is <br />constructed. Mr. Normand advised that he would be willing to place large trees along the property <br />lines to buffer the garage from view. Ms. Geye advised that she is in agreement with Mr. Totten's <br />concerns. She does not want to see the trees removed and believe that the value of the abutting <br />homes would be decreased if the garage is allowed. She also presented photos of what she sees from <br />her baclcyard. She aslced if he would be worlcing out of his garage. Mr. Normand said no.
