J. Bnrke moded to go into eacecutive session to discuss possible litigation. T. Kelly seconded the <br />motion, which was unanimously approved. <br />J. Burke moved to reopen the public hearing. J. Maloney seconded the motion, which was <br />unanimously approved. <br />Mr. lalaloney advised Mr. (Camble that he should toueh bases with the Building Department to <br />petition the boazd to readdress ttieir reqiaest. Mr. Ciamble requested to have the 1Vlacy's proposal be <br />readdressed at the June 1, 2006 meeting. Mr. O'Ma.tley advised the -applicant that it wouid be to his <br />advantage to touch bases with the Buitding Department regarding submittai deadlines. <br />V. Burke moved to adopt the Lee Scbantz area variance order and findings ieport as written. <br />M. l3iver seconded the motion, which vvas unanimonsly approverl. <br />• Building Department (Iteport 1Vlarch 2006) <br />• Jacobs field North Olmsted Night flyer <br />Boazd members completed the area variance order of findings report for Prudence Packer of 27107 <br />Believue Drive as follows: <br />1. The property can yield a reasona.ble return as neighbors have offered to purchase the land. <br />2. The variances being requested are subs#antiai. <br />3. The essential character of the neighborhood would be substantially altered as wouTd iciie abutting <br />neighbors of the lot in question. <br />4. Delivery of govemmental services (e.g. water, sewer, gazbage) would not be altered (negative). <br />5. The applicant stated she was aware of the zoning restrictioms when she purchased the land. <br />6. #6 is not appiicable to the request. (negative) <br />7. The spirit and intent belund the zoning requirement would not be observed nor justice done by <br />granting the vatiance. <br />J.
