90-125 sec4ion (1135.02 (D4)). T. Kelly seconded the motion which was unanimously approved. <br />Variance Granted <br />2. Michael Abnev; 4665 Fleharlv Road: (WRD # 4) <br />Request for variance (1123.12). The proposal consists of above ground swimming pool. <br />The following variance is requested: <br />1. A 35 square foot variance for swiinming pool, (code permits 717 sq ft, applicant shows 752 sq ft). <br />Which is in violation of Ord. 90-125 section (1135.42 (D2)). <br />Mr. Abney and Ms. Kostandaras, each came forward to be sworn in and address the request. Mr. <br />Abney advised that the pool is larger then the allowable rear yard coverage. However it is the <br />smallest pool size availabie. He submitted signed Ietters from the neighbors stating they had no <br />objections to the variance request. Board members had no objections to the applicants' request. <br />T. Kelly moved to grant Michael Abney ofi 4665 FlehaMy Itoad lais request for variance <br />(1123.12), which eonsists of an above ground svdimming pool and that the following variance is <br />granted: le A 35 square foot variance for swamming pool, (code permats 717 sq ft, applicant <br />shovvs 752 sq ft). Which is in violation of Ord. 90-125 section (1135.02 (D2)). M. Diver <br />seconded the motion, which wss waanimously approved. Variance Granted <br />3. Jaanes Bober; 23247 Sharon Drive: (WRID # 21 <br />Request for variance (1123.12). The proposal consists of a 3 season room addition. <br />The following variance is requested: <br />1. A 14 foot rear yazd variance for a residence to close to the rear property line, (code requires 50 $? <br />applicant shows 36 ft). <br />VVhich is in violation of Ord. 90-125 section (1135.08(A)). <br />Mr. & IVirs. Bober each came forward to be sworn in and address the request. Mr. Bober advised <br />that their intent was to convert an existing deek into a three season room. 1VIrs. Diver questioned if <br />there was proper footers already in place. Mr. Bober suggested that the footers of the existing deck <br />wouid be used and they would just be converting the deck into the three season room. Mr. Burke <br />advised the applicaut that the Engineering departnient noted that dowmspouts are required on the <br />three season room. <br />J. Burke moved to grant James Bober of 23247 Sharon Drive his request for variance <br />(1123.12), which consists of a 3 season room and that the following variance is granted: <br />1. A 14 :foot rear yard variance for a residence to close to the rear proper[y line, (code requires <br />50 €t, applicant shows 36 ft). Which is in vaoiation of Ord. 90-125 section (1135.08(A)). M. <br />Diver seconded the moBion, which was unanimously approved. Variance Granted <br />4. Carol Mahon; 24835 'I'ara Lvg Drive: fffM # 2) <br />Request for variance (1123.12). The proposal consists of a 3 season room addition. <br />The following variance is requested: . <br />1. A IB foot rear yard variance for a residence to close to rear property line, (code requires 50', <br />applicant shows 38'). <br />Which is in violation of Ord. 90-125 section (1135.08 (A)). <br />Mr. I3utton with Fairview Home Improvements came forward to be sworn in and address his client's <br />request. Mr. Maloney questioned if Mr. Dutton had permission to represent Ms. Mahon. Mr. Dutton <br />stated that he had the ovvaners' permission and reviewecl that he vvould be enclosing the existing 12' x <br />12' deck and that additional footers would be added. Mrs. Diver noted that the thPee season room <br />would be required to have dawnspouts. Mr. Burke questioned if the lower circular section of deck <br />2
