During roll call of the motion: Mrs. Sergi stated that due to the applicants business having no
visibility from a main road she was in favor of the variance. Mr. Burke agreed with Mrs. Sergi and
said that given the fact that the sign was not illuminated, face I-480 and would not adversely affect
neighbors he was also in favor of the variance. Mrs. Diver felt that a sign facing I-480 constituted a
"billboard" which was unnecessary. She did not believe that the sign could be read by vehicles
traveling at high speeds therefore she voted no.
IV. COMMUNICATION:
Board of Zoniniz Appeals Rules of Procedures:
Special Permit form:
Use Variance form:
Area Variance Reauest form:
Mr. O'Malley commented that the Rules of Procedures submitted were updated by the board in 2005
but they needed to be adopted by motion. He reviewed each of the forms submitted and explained
the specifics of the wording used in each form. The board requested a heading be placed on each
form to be used and requested minor adjustments. The board felt that the forms should be a part of
the Rules of Procedures. Mr. O'Malley advised that the Special Permit and Use Variance forms
would need to be used each time a special permit or use variance is requested as there are time
constraints which must be met by the Board of Zoning Appeals as well as Council. However, the
Area Variance form can be used at the board's discretion.
J. Maloney moved to table the adoption of the forms and Rules of Procedures until meeting
next. N. Sergi seconded the motion which was unanimously approved.
V.
