the garage. Mrs. Sergi had no objections to the 5 foot rear yard variance but the sideyard has not <br />been justified. Mrs. Diver felt the garage could meet the sideyard variance. The owner felt that <br />the proposed location was needed for the safety of vehicle maneuverability and the proximity of <br />his home. Ms. Williamson had no objections to the request as the owner was placing the garage <br />in the same location as the current garage and the new garage is slightly narrower. <br />Mrs. Sergi moved, seconded by Mr. 1Vlenser, to approve David & Jean Chalkwater of 5086 <br />Andrus Ave their request for variance (1123.12), which consists of a new garage and the <br />following variances are granted: <br />1. A 5 foot variance for a garage too close to the rear property line, (code requires 101, <br />applicant shows 51). <br />2. A 1 foot variance for a garage too close to the sideyard pa-operty line, (code requires 51, <br />applicant shows 41). VVhich is in violation of Ordo 90-125 section (1135.02 (C 2) and was <br />unanimously approved 4-0. Mrs. Diver voiced that she was disappointed the applicant was <br />unwilling to move the garage inward 1 foot. <br />William Slama; 28670 Jenkins Road (Ward 1) , • A'.'special permit to add to a non-conforming building (1165.02), existing residence is 1%2 <br />feeti.'from sideyard property line and code requires 5 feet. <br />Request for variance (1123.12). The proposal consists of residential addition. <br />The following variances are requested: <br />1. A variance for section (1165.02) as the addition does not comply with sideyard setback. <br />2. A' 6" foot variance for residence closer too right of way than code allows, (code require 5'0', <br />, applicant shows 44'), section (1135.06 (a)). <br />Whicfi is in violation of Ord. 90-125 sections (1165.02) and (1135.06 (a)). <br />Representatives: Mr. Slama the Owner came forward to be sworn in and address the request. <br />Mr. Slaina said he thought the variance from section 1165.02 was inaccurate as the additiori is <br />for tlie. front of the home not the side of the home. The sideyard setback was granted a variance <br />in 1978: The project includes a second floor addition and front solarium/sunroom. He believed <br />that,_the addition would enhance not only his property but his neighbors as well. The home <br />borders,,Westlalce and is surrounded by dense woods at the end of a dead-end street. All the lots <br />alorig t11e street are deep heavily wooded lots. The size of the addition would be 18' x 29' the <br />majority.of which will be the solarium. Mr. Conway felt that a variance from section (1165.02) <br />was riot needed if the special permit to add to a non-conforming building was granted. 18 feet is <br />subsfantial for a sunroom and felt the 50 foot setback should be maintained. Mr. Slama voiced <br />that fhe" second floor was also being expanded as well as the basement below the solarium. <br />There':will be a recessed entry-way to the front door so the solarium will not be the full width. <br />Mrs: Sergi questioned if the addition would also be over the garage. Mr. Slama reviewed that the <br />18 feet included the distance between the front door and the front of the garage so the addition <br />will only be 6 feet past the front of the garage. 12 feet of the addition is existing space for the <br />porch which will be reused. <br />Mr. O'1Vlalley advised that a special permit is required as well as a variance from section 1165.02 <br />as tYie , addition will not meet front setbaclc requirements.
