neighbczring properties be impacted by the addition. Governmental services would not be altered
and'the ?zoning restrictions are presumed known by owners prior to purchasing their homes. The
property can yield a reasonable return without the variance and the spirit and intent would be
followed granting the variance.
Mr. Menser moved, seconded by Mrs. Diver, to approve Thaddeus & Catherine Radwan of
27608 Laurell Lane their request for variance (1123.12), which consists of an addition and
the following variance is granted: 1. An 8 foot variance for a residence too close to rear
property line, (code requires 501, applicant shows 421). Which is in violation of Ord. 90-
125 section (1135.08 (a)) and was unanimously approved.
NON-RESIDENTIAL APPEALS AND REQUESTS:
Wellin2ton Place; 4800 Cla2ue Road; (Ward 1)
• A?special permit for a construction trailer (1123.06 (a)).
Request for variance (1123.12). The proposal consists of the placement of three construction
trailers:'.The following variance is requested:
1. A S:O foot variance for a construction trailer too close to right of way, (code requires 100',
applicarit show 50'). Which is in violation of Ord. 90-125 section (1137.07 (B1)).
Representatives: Mr. Petrucci the Supernatant for the project came forward to be sworn in and
address, the request.
Mr. Petrucci reviewed that currently there was one trailer on the site but the job required two
additiorial trailers and the area is landlocked so there is no place the trailers can be pl'aced
without?a variance. The proposed three trailers will be set side by side to each other, horizontal
to Brookpark Road as the owner will not allow any trailer placed past the existing dumpster area.
Mr. Conway reviewed that the trailers are allowed by code just not where they are placed the
number°of trailers are not an issue. The owner placed a location restriction which does not allow
the trailers to be placed 100 feet back from the right of way line. Mrs. Sergi asked why three
trailers -.were needed and how long they would be at the site. Mr. Petrucci reviewed that in
addition to his trailer there is a plumbing and electrical trailer and they will be on the site for 10
moritHs: Mr. Conway reviewed that if the trailers were placed on the concrete area it would be
blocki.ng parking which would also require a variance. The 100 foot setback is due to the zoning
being Multi family. If it was retail zoning they could be 75 feet off the right of way. He felt the
applicant chose the best location possible to place the trailers. He had no objections if the trailers
were kept in line at the 50 foot setback. Mr. Petrucci said he would place the trailers in line to
meet, tlie 50 foot setback the Building Commissioner requested.
Mrs::?,Sergi moved, seconded by Ms. Williamson, to approve Wellington Place of 4800
Clague'Road their request for a special permit to have three construction trailers (1123.06
(a)) ;on ;a site also their request for variance (1123.12), which consists of the placement of
the (3) construction trailers and the following variance is granted: 1.
