She told <br />the appl:icant to be sure to pull a building permit prior to doing any worlc in the future. <br />N. 5ergi moved to approve .Tames Conroy of 26869 Sweetbriar Drive his request for variance <br />(1123.12), which consists of a new fence and the following variance is granted: A 6 inch <br />variance for a fence higher than code permits in a front setback, (code permits 30" applicant <br />shows 3611). Which is in violation of Ord. 90-125 section (1135.02 (fl)). R. 1VIenser seconded <br />the motion which was unanimously approved. <br />2. Patricia Burlless; 28282 Northpark Blvd: (WRI) # 1) <br />Request for variance (1123.12). The proposal consists of a new shed. <br />The following variance is requested: 1). A 72 square foot variance for a storage shed larger than <br />code permits, (code permits 120 sq ft applicant shows 192 sq ft). Which is in violation of Ord. 90- <br />125 section (1135.02 (dl)). <br />Ms. Burgess the owner Mr. Styles, and Mr. Jacko a neighbor each came forward to be sworn in <br />and address the request. Ms. Burgess indicated that she would like to have an outbuilding to store <br />her oiitdoor yard tools and a motorcycle. Unfortunately the size of the shed purchased was based <br />on rules. which recently changed. The size of the shed was permitted by code last year and they <br />were "not aware the code had changed. Mr. Styles said they purchased the shed prior to pullirig the <br />permit fo install it and found out the height was 6 inches off. Mr. Jacko said he built his. shed <br />under the old code and his shed is larger than what the applicants are requesting. He has no <br />objections to what his neighbors are asking for. Mr. Conway said that when the changes of the <br />codes were brought about it was the city's intent to reduce the size of sheds an owner is allowed. <br />However on occasions there will be properties such as this with a 195 foot deep backyard which <br />under the old code would be allowed a larger shed which the city has no objections. The <br />applicants request is unique and the building department has no objections to the request as it was <br />permitted a year ago. Mr. Kelly voiced he had no objections due the size of the lot. All members <br />felt the size of the lot would accommodate the structure. In reviewing the standards Mrs. Diver; <br />the property could yield a reasonable return, the property would not adversely affect the <br />neighborhood and unfortunately went by old codes. Governmental services would not be altered <br />property owner purchased home without knowledge codes had changed. Although the applicant <br />can preclude her situation without a variance the request is unique as pointed out by the building <br />comrriissioner. The spirit and intent would be served granting the variance. <br />N. Sergi moved to approve Patricia Burgess of 28882 Northpark Blvd her request for <br />variance (1123.12), which consists of a new shed and the following variance is granted: A 72 <br />square ;foot variance for a storage shed larger than code perrnits, (code permits 120 sq ft <br />applicant shows 192 sq ft). Which is in violation of Ord. 90-125 section (1135.02 (dl)). A. <br />Williamson seconded the motion which was unanimously approved. <br />Dennis & June Beach; 25147 Tara Lynn Drive: (WRD # 2) <br />Request for variance (1123.12). The proposal consists of a new shed. <br />The following variance is requested: 1). A 16 square foot variance for a storage shed larger than <br />code permits, (code permits 80 sq ft applicant shows 96 sq ft). Which is in violation of Ord. 90- <br />125 section (1135.02 (dl)). <br />Mr. &Mrs. Beach the owners each came forward to be sworn in and address the request. Mr. <br />Beach'reviewed that due to his physical size and back problems he requires yard tools larger than <br />the average person and the tractor can not be stored in his garage as there is not enough room for <br />2
