(Chips Away) from August to October for their shoppers. The company does not charge the <br />owner. ?They call the owners insurance companies to take care of payment. The area in which the <br />service will be provided is next to Jared Jewelers and the parking spaces are never used outside the <br />holiday season. Mrs. Diver asked what type of vehicle would be used to perform the service. Mr. <br />Reddiclc presented a photo of a site with the service. The vehicle leaves the site each night and the <br />only reason they would invite them to return is if it has a good response. Board members noted <br />that the;photo was not helpful as you could not clearly see the vehicle or the site. Mrs. Sergi asked <br />what was on top of the vehicle and if the area would be blocked off while in use. Mr. Reddick said <br />there is a sign above the vehicle and he would have them lower the sign if the board wanted. The <br />area will be roped off while in use. Mr. Menser noted that the vehicle/trailer is shown as 30' x <br />100'. Mr. Conway reported that any service station in North Olmsted would provide the same <br />service. The service is not free they accept what vehicle owner's insurance company will pay as <br />any other service station in North Olmsted. This is a profit making business that will take work <br />from local service garages that can do the same thing. It is also taking parking spaces for time <br />frames longer than the city has ever allowed. He is not in favor of the request as it will take work <br />from existing establishments within North Olmsted. The parking spaces in the area outside of the <br />holiday season are not used, however he is concerned of what other businesses will want to come <br />in for 6 months or more at a time. Mr. Reddick said if another mobile business wanted to come in <br />they would need a variance as well. Mr. Conway believed that allowing the traveling business <br />would create unfair business practices. Mrs. Diver said the board never grants parking variances <br />for inore than 2 to 3 weelcs at a time. Mr. Conway noted that the applicant wanted to have the <br />business from April to October (7 months) but did not malce application for variance until recently. <br />Mr. O'Malley advised that the request is for a parking variance and advised the board to disregard <br />lilces or dislilces regarding temporary business. He agreed with Mr. Conway that the board did not <br />usually.grant variances for 6 month periods and it was within the right of the board to request <br />exhibits dealing with traffic flow and visibility of the temporary site. Mr. Reddick said he would <br />be agreeable to have the business for 30 days to give the city an opportunity to see the business <br />first liand. The business is closed by 7:00 pm each night and leaves the premises each night. Mrs. <br />Sergi believed that the request should not be granted more than 30 days to see if any issues arise <br />from tlie use. Mr. Kelly questioned the intent of the service as it was not clear if it would become <br />a perinaiient use or what time frame is considered temporary. The applicant failed to present an <br />accurate reflection as to what will take place. Questions asked pertaining to traffic increasing, <br />what will the trailer look like and why there is not enough information being provide. Mr. Menser <br />voiced he agreed with Mr. Conway but the request is a parking variance and felt that limiting the <br />variarice to 30 days may not be enough time. Mrs. Sergi felt that 30 days would give the city an <br />opportunity to see if the use creates parking issues, traffic issues, if it is visibly unappealing or any <br />complaints are made. Ms. Williamson said she is torn whether or not it should be limited to 30 <br />days: : Mr. Kelly did not feel the board was provided enough information to determine if the use <br />would create issues. In reviewing the standards Mrs. Diver; reviewed that the variance for 24 <br />parkirig spaces is substantial and the character of the area may or may not be altered. <br />Governinental services may or may not be altered depending on how things would be disposed of, <br />if there are lights and how will the traffic be controlled or would it create traffic issues. The <br />owners have lcnowledge of the zoning restrictions. The property can continue to be used without a <br />variance as parking. The spirit and intent be served granting the variance the board is unknown at <br />this time. Mrs. Sergi asked if the use to be taken into consideration includes the appearance of the <br />temporary use. Mr. O'Malley advised that the board would need to envision what the use would <br />look `lilte as it could affect the area. He noted that the board was within their right to limit the <br />timeframe to 30 days. <br />4
