All board members agreed with Mrs. Sergi that a 2 foot variance would be a reasonable <br />compromise. Mrs. Diver asked Ms. Bontempo if she would agree to accept a 2 foot variance to <br />place the garage 3 feet off the property line. Ms. Bontempo asked if it would make a difference <br />if she only built a 1%2 car garage. Mr. Menser advised that it was not the size of the garage it is <br />the placement which is a concern. Ms. Bontempo said she would agree to place the new garage <br />as requested. <br />N. Sergi moved to approve Patricia Bontempo of 23093 Clifford Drive her request for <br />variance (1123.12), which consists of a new detached garage and the following variance is <br />granted as amended and agreed upon: A 2 foot variance for a garage too close to side <br />property line, (code requires 51, applicant shows 31). Which is in violation of Ord. 90-125 <br />section (1135.02 (C2)). T. Kelly seconded the motion, which was unanimously approved. <br />6. John & Lvnda LaBianca; 27326 Nantucket Dr. (WRD # 3) <br />Request for variance (1123.12). The proposal consists of a 3 season room and the following <br />variance is requested: 1. A 14 foot variance for a residence too close to rear property line, (code <br />requires 50', applicant shows 36'). Which is in violation of Ord. 90-125 section (1135.08 (a)). <br />Mr.& 1VIrs. LaBianca the owners and Ms. Oliver a neighbor each came forward to be sworn in <br />and address the request. Mr. LaBianca said they would like to have a three season room to <br />enharice their home as their family has grown and they now have grandchildren. The backyard <br />has no rieighbors as it abuts the North Olmsted High School and creek. The privacy fence leads <br />people to think the property is smaller than what it truly is. They own an additional 20 feet of <br />land beyond the fence. The fence was installed to ensure the grandchildren could not access the <br />creek: Mrs. LaBianca presented photos to the board to see the rear area behind the fence. Ms. <br />Oliver said she was present to support her neighbors and has no objections to the request. Mr. <br />Conway said the building department had no objections to the request. Ms. Sergi did not feel the <br />governmental services would be affected. The spirit and intent would be served in granting the <br />variance. The neighborhood would not be altered or adversely affected by the addition. The <br />variance looks substantial but there is additional land beyond the fence which can not be used. <br />N. Sergi moved to approve John & I,ynda LaBianca of 27326 Nantucket Drive their <br />request. for variance (1123.12), which consists of a 3 season room and the following <br />variance is granted: A 14 foot variance for a residence too close to rear property line, (code <br />requires 50', applicant shows 361). Which is in violation of Ord. 90-125 section (1135.08 <br />(a)). A. Williamson seconded the motion, which was unanimously approved. <br />7. Robert & Gloria Laurent; 24138 Lebern Dr. (WRD # 2) <br />Request for variance (1123.12). The proposal consists of a shed and the following variance is <br />requested: <br />1. A 60 square foot variance for shed larger than allowed, (code permits 80 sq ft, applicant shows <br />140 sq ft). <br />2. A 3 inch variance for height of shed, code allows 8', applicant shows 8' 3"). <br />Which is in violation of Ord. 90-125 section (1135.02 (D1)). <br />Mr. & Mrs. Laurent the owners each came forward to be sworn in and address the request. Mr. <br />Laurent said he would like to replace the existing 10' x 10' shed with a 10' x 14' shed. His <br />garage does not have enough room to store their tools. They spoke to all their neighbors and <br />they have all signed a letter stating they have no objections. The height of the shed will be 3 <br />inches higher than the existing shed due to the pitch. Mrs. Diver voiced that the shed was double <br />5
