Sergi moved to grant Walters Advanced Dentistry of 4780 Clague Rd their request for <br />variance (1123.12), which consists of constructing a new Dental office and the following <br />variances are granted: <br />1. A 50 foot variance for front yard setback, (code requires 100 ft, applicant shows 50'), <br />section (1137.07 (b)). <br />2. A 30 foot variance for parking area and driveway to walls of main building, (code requires <br />301, applicant shows 01), section (1137.08) table. <br />3. A 10 foot variance for parking area to side lot line, (code requires 20' applicant shows 10'), <br />section (1137.08) table. <br />4. A 10 inch variance for south side yard setback, (code requires 241, applicant shows 24' 10"), <br />section (1137.06 (g)). <br />5. A variance for 3 wall signs, (code permits 0, applicant shows 3), section (1163.27(a)). <br />Which is in violation of Ord. 90-125 sections (1137.07 (b)), (1137.08) table, (1137.06 (g)) and <br />(1163.27(a)). T. Kelly seconded the motion, which was unanimously approved. <br />IV. REVIEW AND CORRECTION OF MINUTES: <br />T. Kelly moved to approve the Apri126, 2007 Board of Zoning AppeaTs minutes as written. N. <br />Sergi seconded the motion, which was unanimously approved. <br />Mr. O'Malley advised that the clerk and the building department needed clarification pertaining to <br />the North Olmsted Town Center's variance approvals from May 03, 2007 meeting. The April 4, <br />2007 site plan which was incorporated into the board's motion showed sign C1 on the plan and lists <br />the height as 4 foot 7%z inches, however neither the write-up nor sign criteria submitted included or <br />accounted for the .6 foot height variance specifically. Therefore the building department needs <br />clarification as to whether the board approved sign C1 being 4 foot 7'/2 inches tall or not in their <br />motion of May 3, 2007. Mr. Mathews advised that the building department could not move forward <br />without the board's clarification: A brief discussion ensued regarding whether or not the applicant <br />should be asked to return to the BZA for clarification. Mr. Kelly believed that due to the board's <br />motion approving the Apri14, 2007 site plan and the applicant's amended criteria the board already <br />approved the .6 foot height variance for sign C1, therefore the applicant should not return and the <br />motion stand as written. Mrs. Sergi questioned if the applicant in fact submitted the amended sign <br />criteria which was to reference the Apri14, 2007 site plan. Mr. Mathews was not sure if the building <br />department had received the criteria or not. Mrs. Sergi voiced a frustration of repeatedly being asked <br />to grant variances for amendments which are submitted without being seen. Mr. Menser voiced that <br />he agreed with Mr. Kelly the board motioned on the Apri14, 2007 site plan and what was shown on <br />the plan. Mrs. Sergi, Mr. Kelly and Mr. Menser each agreed that their motion approving the Apri14, <br />2007 site plan therefore approved the .6 foot height variance for sign C1 which was not listed. <br />R. Menser moved to approve the May 03, 2007 Board of Zoning Appeals minutes as written. <br />T. Kelly seconded the motion, which was unanimously approved. <br />V.
