2. John & Susan Powers; 24396 Maria Ln: (WRD # 2) <br />Request for variance (1123.12). Proposal consists of an addition. <br />The following variance is required: <br />1. An 8 foot rear yard setback for addition to close to rear property line), (code requires 50', <br />applicant shows 42'). Which is in violation of Ord. 90-125 section (1135.08 (a)). <br />Note: Existing porch to be removed and replaced with new porch. <br />Mr. & Mrs. Powers each came forward to be sworn in and address the request. Mr. Powers advised <br />that their porch is dilapidated and needs to be replaced as it is more than 30 yeaxs old. They have a <br />similar situation to the Jacobs that they would like to replace their existing patio with a 3 season <br />room. The room will be the same size as the porch being removed. Code requires a 50 foot setback <br />and they will have a 42 foot setback. Mrs. Sergi believed that the addition would be an improvement <br />to the neighborhood and the home itself. Board members voiced that they felt the addition would be <br />a benefit to the neighborhood. <br />N. Sergi moved to grant John & Susan Powers of 24396 Maria Lane their request for variance <br />(1123:12), which consists of an addition and the following variance is granted: An 8 foot rear <br />yard se'tback for addition to close to rear property line), (code requires 501, applicant shows <br />421). -Which is in violation of Ord. 90-125 section (1135.08 (a)). M. Diver seconded the motion, <br />which was unanimously approved. <br />3. Michael Boukzam; 4117 Clague Road: (WRD # 2) <br />• A special permit to add to a non-conforming house/building (1165.02). Existing home has a <br />29_.25 foot front yard setback and a 4 foot sideyard setback. <br />Requesf for variance (1123.12). Proposal consists of an addition to existing non-conforming home <br />and a new detached garage. The following variances are required: <br />1. A 20.75 foot front yard setback variance for new porch, (see note), (code requires 50', applicant <br />show. 29.25'), section (1135.06 (A)). <br />2. A 10?foot sideyard variance for a garage too close to side yard on a corner lot, (code requires 25', <br />applicant shows 15'), section (1135.06 (B)). <br />Which is in violation of Ord. 90-125 section (1135.06 (A)) and (1135.06 (B)). <br />Note: 1). Garage does not require special permit. 2). Applicant is also applying for a rear <br />porch%entrance which meets code requirements. <br />Mr. Boukzam the owner came forward to be sworn in and address the request. Mr. Boukzam <br />indicated that he recently purchased his home and the existing garage has been condemned. The <br />home is an existing non-conforming home as the front yard is only 29 feet from Clague Road. There <br />will be an overhang over both entrances facing Macbeth Road as well as a wraparound deck. Mrs. <br />Diver questioned which of the 3 curb-cuts would be used for the driveway. Mr. Boukzam was <br />unsure how he would use the current driveways. He was unsure if both sides of the garage would <br />have overhead doors or if in fact he would include a turnaround for easy access during heavy traffic. <br />Mrs. ` Diver questioned why the applicant didn't place the garage to code requirements. Mr. <br />Boulczam felt that if the garage was turned to face Macbeth he would lose most of his backyard. In <br />the: future there will be second floor additions to both the home and new garage. Mr. Burke asked <br />for clarification of the garage size, placement and how it would be accessed. Mr. Boukzam <br />reviewed that the garage is a 3 car garage with a covered carport to store his boat. There will be <br />garage doors on both the east and west sides of the garage to allow entrance and exiting from both <br />Clague and Macbeth Roads. If the size of the garage was decreased it would still have to be placed <br />in line with the existing asphalt driveway. If the garage is moved inward towards the house he <br />would have to install additional asphalt driveway to access the garage causing the front yard to look <br />2
