( z <br />? . <br />the variances. Although he is syinpathetic to the applicants needs he could not overlook the future <br />ramifications of the outcome of the request. Mrs. Sergi reviewed with the Building Commissioner <br />issues pointed out in his memo which would be created if the lot sizes variances are granted. Mr. <br />Conway clarified that the issues in his memo were not variances just issues wluch would be <br />, created if the current variances are granted. <br />J. Burke moved to approve Corso's/Szarka Trust, Lot Split Plat of 29691 Lorain Road their <br />request for variance (1123.12), which consists of a lot split and the following variances are <br />granted: <br />1. A 50.26 foot variance for lot vvidth (south parcel), (code requires 150 ft, applicant shows <br />99.74 ft). <br />2. A 1.1146 acre variance for lot area (north parcel), (code requires 1.5 acres, applicant <br />shows 0.3854 acre). <br />3. A 13,451 square foot variance for lot area (south parcel), (code requared 40,000 sq ft, <br />applicant shows 26,549 sq ft). <br />Which is in violation of Ord. 90-125 section 1139.06. T. Kelly seconded roll call on the <br />motion, J. Burke, M. Diver, N. Sergi, R. IVIenser no and T.. Kelly yes. Variances Denieci <br />During roll call of the motion Mrs. Sergi and Mrs. Diver both stated that although they are <br />sympathetic to the families following the boards standards they have to vote no. <br />4. Walters Advancecl Dentistrv; 4780 Clalzue Itoad (WRD # 4) <br />The proposal consists of demolishing existing home & constructing a new Dental office which <br />requires a Use Variance, section: 1123.12. <br />Mr. & Mrs. Walters the owners and Mr. Sampat the architect each came forward to be sworn in <br />and address the request. Mr. Walters reviewed that his family's Dental business had been in North <br />Olmsted since 1963 and their current office is no longer adequate to meet the needs of their <br />growing practice. They would like the opportunity to build their new office at the corner of <br />Broolcpark and Clague Road. Although the outside of the office will be residential looking the <br />interior will have the latest dental equipment available to ensure their clients receive the best care <br />possible. The location was chosen after 3 years of searching and they believe the location and <br />design of the building will be an asset to North Olmsted. An easement from Wellington will allow <br />them to eliminate all curb-cuts along Clague Road or Brookpark Road. They will share a driveway <br />with Wellington and use their existing curb-cut. The Dental office will not impact the <br />neighborhood as the design of the building will fit the character of the neighborhood.. The parking <br />and lighting will be limited and the office is only open 4 days a week from 8:00 am through 6:00 <br />pm with no weekend or evening hours. As there are only 2 Doctors in the practice (Mrs. Walters <br />part-time) traffic volume will be limited and the use is consistent with the development in the area <br />including Wellington Place which is a medical facility. The Planning & Design Commission <br />believed the use and location of the site to be fitting for the proposed use and location. His goal is <br />to create a dental practice which will not only benefit North Olmsted but allow them the <br />opportunity to bring state of the art dental care to their clients. <br />Councilman Orlowski said that although he welcomed the Doctor to the City he did iiot feel the <br />'aeation-was-the-pr-oper-loc-atianfor-hi,s p-actic?I?-s?gg-ested?ha?hP srnke to the a?plicants <br />neighbors each of which would prefer the site remain residential. Each of the abutting structures <br />are residential in nature and he would like to see the site remain residential. The zoning <br />classification of the lot is multi residence and granting variances for the applicant will create a <br />non-conforming dental office in a residential neighborhood. Chapter 1123.10 of the codified <br />governs request for ruling on proposed use standards. The requirements are governed by <br />i paragraphs (a) through (d) and following those standards the applicants request does not meet the <br />? criteria. The area can not accommodate additional vehicle traffic which will be created with 2 <br />doctors and 11 employees. The current nursing home already creates traffic problems in the area <br />5
