BOARD OF BUILDING CODE APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR JULY 17, 2008 <br />ROLL CALL <br />The meeting was called to at 5:45 p.m. in Council's chambers <br />Present: Donna Sabo, Norman Althen, BJ Meder <br />Absent: Dan Jarachovic, Robert Lipcsey <br />Staff: Building Commissioner David Conway, Clerlc of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mrs. Sabo moved seconded by Mr. Althen, to approve the June 19, 2008 Board of Building Code <br />Appeals minutes as written which was approved 2-0 as Mr. Meder abstained. <br />Mrs. Sabo advised everyone present that three votes were required to receive a variance, <br />therefore since there are only three members present applicants could request to be tabled or <br />proceed. Both applicants acknowledged they understood and chose to proceed. <br />NEW BUSINESS <br />Robert & Marv Maver; 6345 Brighton Drive: (Ward # 3) <br />Proposal consists of a fence enclosing rear yard. The following variance is requested: A 67 foot <br />variance to install proposed chainlink fence section in rear yard which will run parallel to <br />existing neighbors fence on the other side of a CEI easement which is in violation of section <br />1369.03 (A (3)). <br />Mr. Mayer said the fence would be on the other side of a 10 foot CEI easement and he would <br />maintain the space between the two fences. Mr. Conway said that there would be sufficient <br />space for maintaining and fences are not allowed within the CEI easement area. Mr. Althen <br />asked if the applicant would have a gate for access to the area. Mr. Mayer said there would be 3 <br />gates one on each side of the house and a rear gate for CEI area access. Mrs. Sabo aslced if the <br />proposed fence would be cantilevered to the side neighbor's fences or posts installed. Mr. <br />Conway noted that the plan did not show a rear gate and requested the owner submit a new plan <br />showing the location and size of the proposed rear gate. Mr. Mayer said new posts would abut <br />each of the neighbor's side fences and he would submit a new plan showing the gate. Mr. Althen <br />said he had no objections as long as there is a gate for access. Mr. Conway asked that the gate be <br />included into the motion. Mrs. Sabo advised that approval would be conditioned upon the gate <br />being installed. <br />Mr. Meder moved seconded by Mr. Althen to grant Robert & Mary Mayer of 6345 <br />Brighton Drive a 67 foot variance to install a section of chainlink fence along their rear <br />yard outside the 10 foot CEI easement area with the condition a gate is to be installed for <br />maintenance access which is in violation of section 1369.03 (A (3)) and was unanimously <br />approved 3-0. _ <br />1
