feet inward from his property line to make sure there is no fence in the swale. Mr. Althen said he
felt that placing a fence 5 feet inward from the property line with a gate would be sufficient if the
easement is 5 feet. He requested the applicants remove or transplant their existing landscaping
inside their fence once installed so maintaining the swale would not become an issue. Mr. Meder
did not object to the variance if the Engineering Department resolves the drainage swale issues.
Mr. Conway said that if there is an easement for the drainage swale and it is not flowing then the
Engineering Department would address the matter. Mr. Way said that there is a drain in the
northern neighbor's yard which the swale drains too and after a heavy rain there is a little
standing water but disappears within 12 hours. They have lived in their home for less than a year
so they are not aware of any flooding issues.
Mr. Meder moved seconded by Mr. Althen to grant George & Victoria Way of 4609
Ashbury Park Drive a 72 foot variance to install a section of fencing 5 feet inward from the
rear property line which is in violation of section 1369.03 (A (3)), conditioned upon
approval of the Engineering Department pertaining to easement swale and the existing
landscaping is to be removed or relocated inside the owners fence so the area between the
fences remain clear and easily maintained which was unanimously approved 3-0.
COMMUNICATIONS
• Building Department reports
April, May and June 2008
ADJOURNMENT
The m et g was adjourned at 6:30 pm
Donna Sa o C ai
nna Rote, Cle of Commissions
Approved:
