Ms. Wenger said the city could place deed restrictions on the land with the owner's consent <br />which would run with the land even if sold to ensure the manner in which the site is developed is <br />as approved. Although it is not a topic for discussion with the commission, council can negotiate <br />it in their approval process. <br />Mr. Lasko moved, secorided by Mr. Rerko, to recommend City Council approve Ordinance <br />2008-117 which would rezone PPNs 236-23-028, 236-23-017, 236-24-019 and 236-24-020 <br />located on Butternut Ridge Road east of Canterbury Road from Single Residence A to <br />Residential Cluster District, with the following recommendations: <br />1. The consolidation plat should be submitted by the applicant and be addressed <br />concurrently with both the development proposal and the rezoning request. <br />2. Council should require appropriate deed restrictions to ensure that the development <br />can not exceed 29 residences on the site. <br />Roll call: Lasko, Meredith, Rerko, Williamson - yes; Bohlmann, Cotner - no. Motion <br />approved 4-2. <br />Ms. Wenger announced that City Council would be holding a public hearing to discuss <br />Ordinance 2008-117 on October 7, 2008 at 7:00 pm. <br />Zonin2 Committee <br />Ms. Wenger said the zoning committee will be meeting to discuss wind power in the near future. <br />Although the Master Plan is only required to be updated every 10 years she would lilce to have <br />the commission start loolcing at the plan again for areas of discussion in committee. <br />Mr. Laslco moved, seconded by Mr. Bohlmann, to excuse the absence of Mr. Malone which was <br />unanimously approved 6-0. <br />ADJOURNMENT <br />The meeting was adjourned at 10:30 pm. <br />a?o h. <br />J J.
