However it was made clear that additional information and <br />documentation needed to be submitted to the commission. Mr. Liggett provided copies of the <br />traffic study and wetlands reports for the record to the clerk. Mr. Lasko said a work session would <br />be scheduled within next week to 10 days to give time for all members to attend. Ms. Wenger <br />advised that proper notice would be given. <br />Mr. Lasko moved, seconded by Mr. Malone, to table COMS07-0026: Biddulph Trail of <br />25747 Butternut Ridge Road, which consists of a cluster home development plan noting the <br />applicant's agreement to extend the City's review period so that the following conditions <br />may be met: <br />• The commission will meet to start the compilation of a draft report for City Council <br />• New site, elevations and landscaping plans are to be consistent with page SK 4 plans <br />dated received Apri130, 2008 <br />• Landscape recommendations are to be incorporated per Mr. Malone and a detailed <br />plant key/listing added. <br />• The association rules/bylaws are to be submitted to the Law Department <br />• Plat maps identify easements including potential option in the engineer's report <br />(12/17/07) pertaining to the un-sewered area on Columbia Road. <br />• Letter documenting owner has control of all parcels related to the proposal <br />• Storm water management calculations per the City Engineer <br />The motion was unanimously approved 5-0. <br />COMMUNICATIONS <br />Ordinance No. 2008-56: <br />An ordinance amending section 1139.01 of chapter 1139 (business districts) of the <br />planning and zoning code in order to regulate the placement of charitable collection bin <br />storage containers in the general retail business district of the city of north olmsted. <br />Ms. Wenger said the ordinance would regulate charitable collection bins as an accessory use in the <br />General Retail Business District which was a similar philosophy to regulating PODS as an <br />accessory use in residential districts. The amendment creates a new accessory use section in <br />1139, to include parking, signage and collection bins. The amendment will limit the number, size, <br />and location of such bins in addition to any signage thereon. Incidentally, this amendment serves <br />to clean up the code by separating accessory uses from permitted and conditional uses, and <br />including similar uses within the permitted uses section. <br />Mr. O'Malley reviewed that the regulation was brought about by concerns that donations would <br />exceed outdoor bins and pile up becoming unsightly. How and if they can be accommodated in <br />the general business district area, policies and options are up for review. Mr. Malone asked if it <br />would govern temporary collection areas. Mr. Conway said that he would have to look at each <br />issuance case by case. They are trying to clean up permanent areas which are a mess. Mrs. <br />Meredith asked how the dimension was established. Mr. Conway said he asked business to <br />submit details on their containers to come up proposed sizes. Mrs. Meredith asked if <br />6
