which is consistent with the prior recommendations of commission which passed 5-2, with Ms. <br />Meredith and Mr. Bohlmann voting no. <br />Mr. Lasko moved, seconded by Mrs. Meredith, to recommend the Board of Zoning Appeals <br />grant COMS07-0016 Clark Gas Station of 28915 Lorain Road a 2 foot 6 inch sideyard variance <br />for parking as shown on the site which passed 6-1, with Mr. Bohlmann voting no. <br />Mr. Laslco moved, seconded by Mr. Rerlco, to recommend the Board of Zoning Appeals grant <br />COMS07-0016 Clark Gas Station of 28915 Lorain Road a 4% lot coverage variance for <br />exceeding allowable lot coverage due to the canopy which was passed 5-2, with Ms. Meredith <br />and Mr. Bohlmann voting no. <br />Mr. Laslco moved, seconded by Mr. Bohlmann, to table the proposal for COMS07-0016 Clark <br />Gas Station of 28915 Lorain Road pending the requested modifications to the plans and the BZA <br />outcome which was unanimously approved 7-0. <br />COM1dIUNICATIONS <br />Ordinance 2008-6 <br />An ordinance amending Chapter 1163 (Signs) of the Zoning Code in order to provide new <br />regulations for temporary signs. <br />Ms. Wenger reviewed that ordinance 2008-6 was composed after meeting with the zoning <br />advisory committee and city staff. Currently the zoning code addresses temporary signage with <br />very little guidance for the building department's enforcement. The current wording in the code <br />results in a proliferation of temporary signage along Lorain Road, particularly during summer <br />months. City departments and Council members receive numerous complaints from residents <br />and other business owners regarding temporary signs. In looking at the sign code it was noted <br />that more than just the temporary sign section needed loolced at such as definition updates, <br />exemptions to permit requirement which basically allows any sign under 12 foot from being <br />regulated. A new section titled attention attracting signs will address inflatables and other safety <br />hazard types of signs. The amendment to the temporary sign section provides allowances to <br />ensure free speech but regulates that they are temporary signs not permanent fixtures. There is a <br />section for residential property as well as non-residential property. Residential property is <br />allowed more temporary signs than coinmercial property, as commercial properties have access <br />to ground, wall and window signage as well. Non-residential signs are regulated as to what type <br />of signs, the location, the maximum area and height, the design as well as standards which will <br />not allow illuininated or changeable copy/text as permanent signage allows. The code will also <br />require that all temporary signs be professionally designed. There is a section which covers <br />marketing a property or a vacant building. Some temporary signs will require a permit from the <br />Building Department with drawings, which if approved will be issued a sticker which is to be <br />displayed on each sign approved. She noted that businesses would be limited as to how many <br />stickers they could be issued each calendar year to two. The code addresses both single <br />occupancy buildings as well as multiple tenant sites. <br />4
