and in fact believed the location to be appropriate. Mr. O'Malley briefly reviewed the history of <br />the Telecommunications Overlay District and why it was created. He reviewed areas in which <br />antennas are allowed by federal laws and advised that towers could not be closer than %z mile <br />from each other. He advised the board to base their ruling/findings on the facts they were <br />presented. Mrs. Sergi asked if the variance covered any residentially zoned property line or a <br />specific property line. Mr. O'Malley said the variance is from any residential property line and <br />noted the nearest building was more than 500 feet from the tower. <br />Mrs. Sergi said the property could continue to yield a reasonable return and the variances are not <br />substantial based on the location of any residential home. The nearest building is the Welcome <br />House and it is commercial although there are residents housed in the building. The location is <br />the least offensive to the area. The applicants have done the best they can to keep the tower <br />away from residential homes. The area will be fenced in and landscaped and will not alter the <br />character of the neighborhood. Governmental services will not be altered nor used. Mr. <br />O'Malley noted that some of the homes neighboring the site were used as offices not homes. <br />Mrs. Bellido felt that the tower was far back enough that it would not adversely affect <br />neighboring owners. The general accessibility to the site is limited although T-Mobile will have <br />24/7 access. She liked that additional antennas would be co-located to ensure the number of <br />towers was limited to one. <br />1VIrs. Sergi moved seconded by 1VIrs. Bellido, to grant COMS08-0003: T-Mobile of 29708 <br />Lorain Road A 269 foot variance for setback from residential property line, code requires <br />300 ft, applicant show 31 ft., section 1151.05 (c) (1), contingent upon the parcel being <br />rezoned ancl added to the telecommunications overlay district, which was unanimously <br />approvecl3-0. <br />COMS08-0005 Scott Culp; 5118 Porter Road (Ward 1) <br />Request for variance (1123.12).
