CI7'Y OF NORTH OLMSTED <br />(e) Evidence of Compliance. All applications for local license and registration certificate shall include the <br />following documentation, to be supplied by the applicant: <br />(1) A certificate of insurance for general liability for bodily injury and property damage in the <br />amount of $250,000.00; <br />(2) A certificate of insurance for construction claims and unworkmanlike performance in the <br />amount of $250,000.00; <br />(3) A certificate of coverage from the Bureau of Workers' Compensation; and <br />(4) Federal tax or payroll identification number or Regional Income Tax Account number or other <br />evidence of registration and/or certification of compliance with RITA withholding. <br />( fl Issuance of Certificate. The Building Commissioner, upon receipt of all required fees, documentation <br />and evidence of compliance necessary to satisfy the provisions herein, shall issue or deny a certificate of registration for <br />a state licensed contractor pursuant to subsections (c) and (e); shall issue or deny a local license certificate pursuant to <br />subsection (d) and (e) ; or shall issue or deny both forms of certification to qualified applicants. An application shall not <br />be deemed to have been approved until the Building Commissioner has examined such application, determined therefrom <br />that the applicant has satisfied the requirements of Section 1317.04, and has issued a certificate for local license or a <br />certificate for registration of state licensee or both. <br />(g) Appeals. The applicant for a local license or registration certificate may appeal from the denial by the <br />Building Commissioner to the Board of Building Code Appeals. The Board shall hear and decide the appeal at its next <br />regular meeting. At the discretion of the Board of Building Code Appeals, after a review of records and an oral <br />examination, a temporary local license certificate may be issued but not to exceed two years in duration. After the two- <br />year probationary period, the applicant may reapply to the Building Commissioner and, upon appeal, the Board shall <br />either deny or affirm the application. An applicant for a local license certificate or a probationary local licensee may <br />obtain a state license or certification and also apply for registration thereof under subparagraph (c), which registration <br />shall be independent of the local license requirement with respect to the work or trade so licensed by the State. <br />(h) Records. The Building Commissioner shall keep a record of all certificates of registration and <br />certificates for local licenses, and together with other documentation forming the basis for the issuance, or the denial <br />thereof, on file for not less than three years. <br />(Ord. 2002-124. Passed 10-1-02.) <br />1315.04 POWERS AND DUTIES. <br />The Board of Building Code Appeals, subject to the authority conveyed by Article VII, Section 1 of the <br />Charter, shall have the power to: <br />(a) Affirm or reverse, in whole or in part, or modify, any decision of the Building Commissioner <br />interpreting the provisions of this Part Thirteen - Building Code; <br />(b) Vary the application of any provision of this Building Code to any particular case, when in its <br />opinion, enforcement thereof would do manifest injustice, would be contrary to the spirit and the <br />purpose of this Building Code or the public interest; <br />(c) Determine if any material or method of construction may be used, even though not specifically <br />authorized by this. Building Code, and specify the manner in which such materials and methods shall <br />be used; <br />(d) Determine any requirement for the strength or stability of an existing or proposed building or <br />structure, or for the safety or health of the occupants thereof, not specifically covered by this <br />Building Code, or not readily interpretable from the provisions of this Building Code; <br />*?* <br />1315.12 VARIATIONS AND MODIFICATIONS. <br />The Board of Building Code Appeals, after public hearing may vary the application of any provision of this <br />Building Code to any particular case when, in its opinion, enforcement thereof would be manifest injustice, would be <br />contrary to the spirit and purpose of this Building Code or public interest or when, in its opinion, the interpretation of <br />the Building Commissioner should be modified or reversed.
