?'. --.. <br />BOARD OF BUILDING CODE APPEALS <br />CITY OF NORTH OLMSTED <br />AGENDA FOR AUGUST 20, 2009 <br />laOLL CALL <br />The meeting was called to at 5:45 p.m. in Council Chambers. <br />Present: Donna Sabo, Norman Althen, BJ Meder, Robert Lipcsey, Dan Jarachovic <br />Staff: Assistant Building Commissioner Dale Mitchell, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Meder moved, seconded by Mr. Althen to adopt the May 21, 2009 minutes with the <br />amendment that Mr. Althen moved to elect Mr. Meder as Vice Chair which was <br />unanimously approved 5-0. <br />NEW BUSINESS <br />George G. Douzos; 4533 Carsten Lane: <br />Proposal consists of a fence enclosing rear yard. The following variance is requested: <br />A variance to construct a 51 foot section of wooden privacy fence along the rear <br />property line where a neighbor's chainlink fence exists, which is in violation of <br />section 1369.03 (A (3)). <br />Mr. Douzos was sworn in and said his 42 year old fence was dilapidated and needed to be <br />replaced. There is an existing chain linlc fence behind his fence and some time in the 90's the <br />law changed and both fences are no long allowed and his neighbor doesn't want his fence <br />removed. Mr. Mitchell said the building department had no objections to the applicant's request <br />as long as the gate is installed for maintenance. Mr. Lipcsey questioned the removal of chain <br />link section which the neighbor allowed in writing and Mr. Douzos said it would be removed as <br />the new fence is installed. Mr. Althen aslced if there would be a gate to maintain the area and <br />Mr. Douzos said there would be a gate. Mrs. Sabo questioned if there was a utility easement and <br />Mr. Mitchell said there was no easement on record. Mr. Douzos said the fence would be a 4 feet <br />high wooden fence placed 2 feet inward from the chain link. A brief discussion ensued <br />regarding the photos provided and the 51 foot area in question. Mrs. Sabo questioned the <br />existing distance between fences and Mr. Douzos said there is now 5 feet and he would like to <br />take it to 2 feet. Mr. Meder asked about the layout of the fence and Mr. Douzos said he would <br />run the fence 2 feet inward from the chain link until 19 feet from the utility pole then it will kick <br />out to go around the utility pole. Mr. Althen felt tlie fence needed to be replaced but there should <br />be a minimum of 3 feet between the fences and all board members voiced their agreement and <br />Mr. Douzos agreed to do. <br />Mr. Althen moved, seconded by Mr. Jarachovic to grant George G. Douzos of 4533 <br />Carsten Lane a variance to construct a 51 foot section of wooden privacy fence along <br />the rear property line where a neighbor's chainlink fence exists, which is in violation <br />of section 1369.03 (A (3)) conditioned upon the fence being installed with a 3 foot
