The spirit and intent of the zoning code would not be upheld granting a variance. <br />Mrs. Sergi moved, seconded by Mr. Lopez, to grant Frank Montegani of 5195 Park Lane a <br />43.6 foot variance for distance of the addition to rear property line; code requires 50', <br />applicant shows 6.41, which is in violation of Section 1135.08(a), in addition to a variance <br />from Section 1165.02 as existing rear yard setback is 26.4 ft and existing front setback is 36 <br />ft, code requires 50' for both front and rear setbacks. Roll call: Diver, Bellido, Sergi, <br />Lopez - no, Rudolph - yes; motion failed 4-1. <br />COMMUNICATIONS <br />Mr. O'Malley said he would like to schedule a BZA training prior to a regularly scheduled <br />meeting. Mrs. Diver asked board members to check their schedules and let her know what time <br />and date would be best so she could set a date with Mr. O'Malley. Mr. Lopez and Ms. Rudolph <br />said meeting at 6:00 pm would work. The members said they would get back to Mr. O'Malley <br />with a date that would work for them to come in early. <br />Mr. O'Malley reviewed the minor changes made to the Board of Zoning Appeals application and <br />rules of procedures requested.
