The spirit and intent of the zoning code would not be upheld granting a variance.
Mrs. Sergi moved, seconded by Mr. Lopez, to grant Frank Montegani of 5195 Park Lane a
43.6 foot variance for distance of the addition to rear property line; code requires 50',
applicant shows 6.41, which is in violation of Section 1135.08(a), in addition to a variance
from Section 1165.02 as existing rear yard setback is 26.4 ft and existing front setback is 36
ft, code requires 50' for both front and rear setbacks. Roll call: Diver, Bellido, Sergi,
Lopez - no, Rudolph - yes; motion failed 4-1.
COMMUNICATIONS
Mr. O'Malley said he would like to schedule a BZA training prior to a regularly scheduled
meeting. Mrs. Diver asked board members to check their schedules and let her know what time
and date would be best so she could set a date with Mr. O'Malley. Mr. Lopez and Ms. Rudolph
said meeting at 6:00 pm would work. The members said they would get back to Mr. O'Malley
with a date that would work for them to come in early.
Mr. O'Malley reviewed the minor changes made to the Board of Zoning Appeals application and
rules of procedures requested. Board members briefly reviewed the changes that were made and
advised that they would hold off adopting them until the next meeting so further suggestions
could be looked at.
ADJOURNMENT
The meeting adjourned at 9:45 pm.
.....??C?!
M ureen Diver, air
Approved:
r D a Rote, Clerk o Commissions

5
