NON-RESIDENTIAL APPEAI.,S AND REQUESTS: <br />Inchin's Barnboo Garden; 5106 Great Northern Shoupinl! Center: <br />Request for variance (1123.12). Proposal consists of signage; the following variances are <br />requested: <br />1. A 57 square foot variance for total wall signs on a unit (2 signs); code permits 79 sq ft, <br />applicant shows 136 sq ft. <br />2. A variance for a second wall sign on a unit; code permits 1 applicant shows 2. <br />Proposal is in violation of Ord. 90-125 section 1163.25 (a) &(c). Note: BZA tabled 5/7/09 <br />Mr. Khan with Neon Signs was sworn in and said his clients were seeking a variance for three <br />wall signs as there are three restaurants. A brief discussion took place regarding the number of <br />signs and businesses being discussed. Ms. Rudolph described the Building Commissioner's <br />memo identifying that there were two entities in one space therefore the Banquet was a separate <br />entity not requiring variances. Mrs. Sergi noted the variances were for Bamboo Garden and <br />Tadka. Ms. Rudolph asked if the name Tadka alone could be used to decrease the total square <br />footage and Mr. Khan said the name alone would not identify Tadka was Indian food. <br />Mr. Mitchell explained the Building Commissioner's memo and said the remaining two <br />businesses which share a space are allowed 79 square feet of signage total for both businesses. <br />The Bamboo height was decreased to 4 feet, and due to the signs being stacked the letters are <br />small as they can be and still be visible from the right of way. The square footage requested is <br />half of what was requested in May so he is comfortable with the sign package as submitted. <br />Mr. O'Malley advised the board to address the variances as written and noted the height variance <br />which was denied in May. Ms. Rudolph said although it loolced like a lot of signage the square <br />footage was reduced and the setback from the street is such that the signs could not be any <br />smaller or visibility would be lost. Both businesses need recognition regardless if they share a <br />space. Mrs. Bellido felt the strip center could accommodate the proposed signage without <br />affecting the character of the center and governmental services would not be affected. Mr. Lopez <br />appreciated the applicant using an existing vacant space and believed that both signs were <br />needed to identify the food styles offered. Mrs. Sergi agreed with comments pertaining to fitting <br />into the center. Mrs. Diver thanked Mr. Mitchell for his explanation of the commissioner's <br />determination and agreed with other board members' comments. The board recognized that the <br />applicants were trying to minimize the variances needed. <br />Mrs. Sergi moved, seconded by Mrs. Bellido, to grant Inchin's Bamboo Garden of 5106 <br />Great Northern Shopping Center the following variances: (1) A 57 square foot variance for <br />total wall signs on a unit (2 signs); code permits 79 sq ft, applicant shows 136 sq ft. (2) A <br />variance for a second wall sign on a unit; code permits 1 applicant shows 2, which is in <br />violation of Ord. 90-125 section 1163.25 (a) &(c).
