PLANNING & DESIGIV COMMISSION <br />CITY OF NOY2TH OLMSTED <br />MINUTES FOR FEBI2UARY 11, 2009 <br />120LL CALL <br />Mr. Laslco called the meeting to order at 7:40 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: John Laslco, Melissa Meredith, Jiin Cotner, Angela Williainson, Greg Malone, Don <br />Rerlco, Ralph Bohlmann <br />Staff: Plailning Director Kim Wenger, City Engineer Dan Collins, Assistant Law Director <br />Bryan O'Malley, Assistant Building Commissioner Dale Mitchell, Clerk of <br />Commissions Donna Rote <br />A moment of silence was observed for inilitary members who have given their lives in the <br />service of our country. <br />REVIEW AND COItRECTION OF 1VIINU'I'ES <br />Mr. Laslco moved, seconded by Mr. Malone, to approve the Planning & Design Commission <br />minutes of January 14, 2009 which was unanimously approved 7-0. <br />NEW BUSINESS <br />C1VIS09-02: Lot Split of PPIrT 237-25-008 at 238651VIastick Road: <br />Representatives: Ms. Drossis and Mr. Montegani <br />Mr. Laslco said the proposal consisted of splitting parcel PPN 237-25-008 located at 23865 <br />Masticlc Road into two (2) parcels (A&B) located in the Single Family Residence A Zoning <br />District, creating lots: <br />• Parcel A- 0.8741 acres with frontage and access from Park Lane. <br />• Parcel B- 1.0901 acres with frontage and access from Masticlc Road. <br />He noted that Parce1237-25-008 was non-conforming as it does not meet minimum lot width of <br />80 feet as 28.35 feet is shown however BZA granted a lot width variance. Parcel A once created <br />would have a non-conforming building as a result of the lot split. <br />Ms. Wenger said the existing lot is a flag lot with a driveway onto Mastick Road, but the bulk of <br />the 2-acre parcel is at the baclc of the lot and also has access to Parlc Lane. Once the lot is split, <br />Parcel A containing the house will continue to have access to Parlc Lane and Parcel B will be <br />vacant and have access onto Mastick Road. Due to the narrow lot width at Masticlc a variance <br />was sought and granted by the BZA. Mr. Collins noted the size of the two parcels being created <br />and questioned how the home ended up with two mailing addresses. He recommended the lot <br />split and requested the plat show parcel A with a Parlc Lane address. Mr. O'Malley reviewed <br />Chapter 1101 pertaining to minor subdivisions. He noted that the request did not include <br />rezoning of any lots. The lot did not have sufficient lot width which was an existing condition <br />and a variance was granted. <br />1
