3. A variance to alter, enlarge, or add to a non-conforming building; code requires <br />addition to comply with setback, yard coverage and height requirements; applicant <br />shows addition exceeds lot coverage, Section 1165.02(b)(1). <br />The recommendation is based upon the fact that the variances are required for the <br />applicant to proceed with the development and the parking neecis of the site do not warrant <br />114 parking spaces. The use is a continued use and would not create an adverse impact <br />upon the neighborhood. Lot consolidation is required. The motion was approved 5-0. <br />Mr. Parry aslced if the BZA has the ability to restrict the nature of the use to its current use to <br />ensure a future owner would not require additional parking. Ms. Wenger said that if there is ever <br />a future owner they would have to be aware of the parking restrictions. She would not want to <br />see a use restriction placed upon an area variance. Mr. Mitchell said the variances are voided if <br />the use of the land changes from its cunent use. Mr. Parry felt that placing the condition of lot <br />consolidation on the approval would ensure they are consolidated. Mr. O'Malley said the <br />required variances are based upon all three lots being consolidated. <br />Mr. Lasko moved, seconded by Mr.1VIalone, to approve the development plan for CMS10- <br />07: Fish Furniture of 23770 Lorain Road which consists of an addition to an existing non- <br />conforming building and site improvements contingent upon the BZA granting variances <br />and the following conditions: <br />Require lot consolidation of all three lots <br />2. Consider flaring/angling of loading dock retaining wall to accoanmodate truck deliveries <br />3. Modification of north elevation to lower the wall light <br />4. Plant 5 crab apple trees along the rear landscape area; planting size for trees are to be a <br />minimum of 2 inch caliper and the arborvitaes to be 5 to 6 fee tall when planted. <br />Existing trees are to be shown on the plans and those being removed marked. <br />The motion was approved 5-0. <br />COlVIMUNICATIONS <br />Ms. Wenger advised that there were a number of upcoming proposals and encouraged <br />Cormnission members to give as much prior notice as possible if they would be absent. <br />Mr. Lasko moved, seconded by Mrs. Meredith, to excuse the absences of Don Rerko and <br />Ralph Bohlmann which was approved 5-0. <br />ADJOURNMENT <br />With no further business, the meeting was adjourned at 8:40 p.m. <br />J Laslco, ., Chair ?onna R'fe, C erlc of Commissions <br />? s <br />Approved
