CITY of NORTH OLMSTED <br />Mayor Kevin M. Kennedy <br />BOARD OF ZONING APPEALS <br />ORDER AND FINDINGS <br />Applicant: Key Bank <br />Address: 26380 Great Northern Shopping Center <br />Proposal consists of signage. The following variance is requested: <br />1. A variance for one (1) additional ground sign on a lot; code permits two (2), applicanf <br />shows four (4), Section 1163.27(a). Note: A variance was previously granted for one <br />additional ground sign on a lot. A variance for three (3) walls signs was granted on <br />8/7/07. A square foot request was denied. Wall signs must not exceed 96 square feet <br />for building. <br />Date of Hearing: October 6, 2011 <br />Practical Difficultv Standards: <br />1. Z Affirmative = Denv Negative = Grant The business has and can continue to yield reasonable <br />return and/or beneficial use without variance for monument sign by virtue of additional wall signs <br />visible from Brookpark Road right of way. <br />2. ? Affirmative = Denv Negative = Grant The variance is substantial in terms of the number of <br />grounds signs on the parcel, especially when combined with previous variances granted for additional <br />wall signs. <br />3. ? Affirmative = Deny Neqative = Grant The Building Commissioner objected that monument. <br />signage for one of several out lots fronting a multiple tenant plaza would set negative precedent. <br />However, the essential character of this highly commercial area would not be substantially altered nor <br />would adjoining properties suffer a substantial detriment. Nonetheless the excessive signage <br />proposal remains unreasonable. <br />4. Z Affirmative = Deny Neqative = Grant Government service not affected. <br />5. Z Affirmative = Denv Negative = Grant Having previously petitioned for variances, the property <br />owner cannot deny knowledge of the signage restrictions. <br />6. Z Affirmative = Deny Negative = Grant The property owner can and already has cured its perceived <br />predicament of visibility by installing additional wall and ground signs based upon variances granted <br />by this Board in 2007. <br />7. Z Affirmative = Grant Neqative = Deny The sprit and intent of the Code and substantial justice <br />would not be reasonably served by adding another ground sign when existing nonconforming ground <br />sign already displays business name. <br />WWW.NORTH-OLMSTED.COM
