I a <br />I will not be in attendance at the November 21, 2011 PDC meeting, but I wanted to provide my <br />comments on the Lucky Brealc Cafe proposal. <br />Variance 1 for insufficient spacing shows that Luclcy Break Cafe will be within 500' of a <br />residentially zoned property. Code requires a minimum distance of 500' measured from the <br />closest point of the building AND parking lot of the business to the residentially zoned property. <br />The handout I received looks lilce the distance is being measured from the building and not the <br />parking lot. I would want clarification on this point as it would impact the number of residential <br />properties that are within the 500'. <br />Also at the last meeting I questioned if Kiddie Kollege was within 500' as the code states there <br />needs to be a min distance of 500' to any private or public school. The Administration was going <br />to see how Kiddie Kollege was classified/certified. If you look at their website, Kiddie Kollege is <br />in fact a pre-school. Regardless of how they may or may not be classified with the city, I believe <br />having an Internet cafe located within 500' of this school violates the intent of the code. <br />I also have serious concerns regarding a variance for parking. Utilizing parlcing on the north side <br />of Broolcpark Road extension not only violates our code, but it also creates an extreme safety <br />concern. I believe that the applicant needs to meet the minimum parking requirement. Since <br />Arturo's has re-opened, there are few parking spaces available in the evening. I've already <br />witnessed customers parking near the Wild Birds Unlimited plaza who are there to patronize <br />Arturo's. Adding a business who doesn't meet the minimum requirement for parking will only <br />exasperate the situation. Based upon the information that I have been presented thus far, I would <br />hesitant to recommend approval of the variances or grating of the conditional use permit. <br />Melissa Meredith <br />Chairman <br />North Olmsted Planning & Design Commission. <br />4
