Mr. Dubelko indicated <br />that goes without saying that motion also includes in addition to the passing of those two <br />ordina.nces the developer compiling with all provisions of the two ordinances. In the framing of <br />the motion Ms. Fox aslced if she would've come after the ordinance was passed would slie had <br />to have come before the board. NEW DEVELOPMENTS AND SUBDIVISIONS; No items. <br />V. COMMUNICATIONS: <br />A) Ordinance No. 98-130; <br />New chapter for Wireless Telecommunications facilities regulations and Wireless <br />telecommunication facilities overlay (WTFO) district. <br />Mr. Tallon aslced Mr. Dubellco to review ordinance 98-130. 1VIr. Dubellco indicated the <br />ordinance creates a new chapi:er in the zoning code to provide for the locations of wireless <br />communications facilities. Essentially these facilities are permitted as a matter of rights in <br />certain areas and one of those areas are easements or parcels for electric or high tension power <br />lines, lilce we had here tonight. The other area is interstate rights of ways. Proposals in those <br />two areas are permitted as a matter of rights. Otherwise these facilities ai•e permitted with <br />conditional use permits within the overlay districts, then you get into the other ordinance 98- <br />131 which is going to ainend the zoning map of the city to provide for these overlay districts, <br />(little circles) in different areas over the existing zoning districts in the City. That is the basic <br />frame work. The rest of 98-130 goes into regulating the standards and regLilations that govern <br />the heights, size and types of materials that are required for these types of towers or antennas. <br />That's kind of a broad over view of ordinance 98-130. Ordinance 98-131 which will be <br />reviewed next should rea.lly be loolced at hand in hand with 9$-130, 98-131 amending the <br />zoning map you have to look at the locations of these overlay districts. Were the City would <br />want to permit these facilities, other than along interstates, and other than neai- these high <br />tension lines such as in retail and industrial oi- mixed use districts that you believe tlzese facilities <br />should be located. Mr. Dubelko reviewed the history of the preparation of the ordinances. Mr. <br />Dubellco indicated Mr. Conway, Mr. Jenkins the safety director, himself, and Mr. Hunt who is a <br />telecommunications attorney that the City has hired to assist in the preparation of this <br />legislation, had several meetings and loolced at different locations in the City which they felt <br />these overlay districts should exist. There is nothing in writing as to were they should go, but <br />there were thoughts that the overlay districts should be in the industrial park area which would <br />be an ideal location, Springvale Golf course would be a location, and there were some <br />discussion as to Great Northern Mall. Essentially they were tiying to find a.reas in the City in <br />which the towers could be distanced from residences. Mr. Dubellco aslced Mr. Conway if he <br />had anything to add.
