When for example the City allows automotive <br />shops to go into retail and have them a hundred feet away from residents it creates the potential <br />for a lot of noise, fumes and impact on the residents that the City might not have in an industrial <br />district. There are many different ways for handling this, conditional use, permits, overlay zoning. <br />Mr. Tallon suggested, looking at the map, as you go east most lots are 500 feet or less, once you <br />get past Stearns west there are about a dozen lots that are over 500 feet. This is a good idea to <br />keep it away from the residents and as long as the law department doesn't have a problem with <br />this ordinance, he doesn't have a problem. Mr. Dubelko indicated the Law Department doesn't <br />have a problem distancing kennels from residents. Mr. Brennan indicated you could simplify this <br />by mandating so many animals per acre, lets face it you can put up an eight story building and <br />have an interior kennel. Mr. Tallon suggested the 700 feet remain so the kennels would be limited <br />to buffer the residents. Mrs. Cameron Alston questioned if the proposed legislation was modeled <br />after a legislation from another community or is it unprecedented this type of legislation. Mr. <br />Dubelko suggested the law department did not do any extraordinary research of neighboring <br />communities because there was the belief that a large kennel operation was coming. The Law <br />Department put together the legislation on a fast track, to quickly get it before council. Mr. <br />Dubelko indicated that Councilman Michael Gareau Jr. has suggested that he may look else were <br />to see if surrounding communities have regulated kennels. Mr. Tallon asked if there were any <br />further questions. Mr. Brennan questioned if this type of kennel goes into the industrial zoning <br />area then they have to comply with the industrial zoning that is already in effect. Mr. Dubelko <br />stated that Mr. Brennan was correct. <br />Mr. Tallon moved to make a motion that Planning commission send Ordinance no. 98-111 back <br />to Council and tell them that the Planning commission agrees with the proposed ordinance. The <br />motion was seconded by T. Brennan, and unanimously approved. 1Vlotion Carried. <br />X. ADJOURNMENT: <br />R. Tallon moved to excuse the absence of R. Koeth. The motion was seconded by K.
