Also included on the Plat <br />designated as Exhibit A is the Vacation of a small strip of existing Mill Road Right-of-Way no <br />longer required, due to the roadway re-alignment. The motion was seconded by K. O'Rourke and <br />unanimously approved. Motion Carried. <br />V. CONIMUNICATIONS: <br />Ord. 98-3 6 <br />Mr. Tallon noted this is "An ordinance creating new and revised Section 1163.12 of the Zoning <br />Code of the City of North Olmsted, in order to permit businesses to be identified on Permanent <br />Pylon and Ground Identification Signs in business areas containing more than one building, and <br />business buildings containing more than one business unit, as amended." Assistant Law Director <br />Dubelko stated that it has been brought to the city's attention, possibly by the Chamber of <br />Commerce, that there is a provision in the sign code which prohibits certain business owners and <br />tenants from advertising on what are called "identification signs" according to the code. In retail <br />businesses "identification signs" are either pylon signs are ground signs which are close to the <br />Right-of-Way. Mr. Dubelko explained, the way the code is presently written, it only permits <br />identification of the plaza itself and it was brought to the city's attention that this limits the <br />opportunity for businesses to identify themselves near the Right-of-Way. The ordinance has been <br />amended to allow any property owner in a business district on these identification signs to identify <br />the name and address of any tenant on the property. Mr. Dubelko confirmed that ordinance 98- <br />36 does not change any provision of the code dealing with maximum signage as it only deals with <br />the information that is pernutted on the sign. The Law Department favors this ordinance because <br />it is more workable, gives more latitude to the business community to identify their tenants on <br />these identification signs, and at the same time it does not work against any substantial city <br />interest that might be involved with traffic safety or aesthetics of these signs. Mr. Brennan <br />questioned if the ordinance would restrict non-pertinent information, such as phone numbers, <br />from being included on the sign. Mr. Dubelko confirmed presently the only thing pernutted on <br />these signs is the name of the plaza, but the ordinance has expanded that to include business name <br />and address on the sign. Chairman Tallon opened up discussion for audience participation. Mr. <br />Gaxland, representing the North Olmsted Chamber of Commerce, applauded the change and <br />noted there was a hearing on August 4, 1998 at 7:00 P.M. which was adjourned after 5 minutes <br />and rescheduled for September 14, 1998. He questioned the effect of this evenings meeting on <br />that hearing and noted the city has changed the essence of the ordinance that council was holding <br />the hearing on. Mr. Ga.rland appreciated this minor change, but encouraged the city to look at the <br />entire ordinance so that the entire business community could be fairly treated. He elaborated 80 <br />percent of the signs in the city do not meet code requirements, and the amendment will bring <br />about 3-4 percent more into compliance. Mr. Garland noted the commission has consistently <br />been allowing the pole signs. Mr. Koeth advised signs do not come in front of this commission. <br />Mr. Dubelko clarified Council continued the hearing concerning Ordinance 98-36 until the <br />September 15, 1998 so that they could get a recommendation from the planning commission. <br />R. Tallon moved to recommend that council pass Ordinance 98-36, seconded by T. Brennan. <br />Roll call on motion: Tallon, yes; Brennan, yes; ORourke, yes; Cameron-Alston, yes; Spalding, <br />abstained; and Koeth, yes. Motion Carried. . <br />VI.
