Mr. Tallon stated this proposal is not for Olive Garden but for Bakers' Square. <br />Mr. Forester questioned if there was an ord.inance prohibiting roof lighting. Mr. Tallon stated <br />although there was not an ordinance specifically prohibiting roof lighting this commission has the <br />right to make a recommendation to city council on the proposal presented before them. He <br />elaborated the coimnission does not want a fixture that shines out from the building but would <br />prefer a fixture that shines down. Mr. Forester agreed to shield the light down. Mr. Brennan <br />noted the "J-2" fixture is basically a shielded fixture and he suggested carry'mg that same fixture <br />arou.nd to complete the concept. Mr. Forester advised the different types of fixtures were used to <br />create a variety and enhance architectural features. He elaborated the "J-2" fixture is a decorative <br />fixtu.re, however, the 'U' fixtu.re is a utility fixture. Mr. Forester concluded he would like to keep <br />the two different types of fixtures and would shield the `U' fixture down as recommended. Mr. <br />Forester did not have any colored renderings or material samples to present but believed the <br />photographs were a good representation of the proposaL He confinned the existing brick will be <br />painted using "Elastameric paint" which is designed specifically for masonry. It was noted the <br />existing brick is not painted. Mr. Forester confirmed when `Bakers Square" is remodeled it is <br />typically painted and there is a three to five year paint cycle. The square footage of the restaurant <br />will remain the same. Although-the existing parking will remain the same there will be some <br />remodeling on the inside of the bu.ilding. The number of seats inside the restaurant are to remain <br />the same as the existing building. There are no plans to expand the existing landscaping. <br />Chairman Tallon opened up d.iscussion for audience participarion and the following people had <br />concems about the proposal: Mr. Cannpbell; Mr. Demeter; and Mr. Buckendahl. These concerns <br />included: if the parking lot will be expanded; if entertainment is permitted in the evening hours as <br />this can get awful loud; if the property owner would begin routine property ma.intenance as the <br />grass is awful long along the southern border of this property; and the invasion of the business <br />district on a residential area. As noted previously in the meeting there were no plans to expand the <br />parking lot. Mr. Siuvns, regional manager, stated he found out about the Thursday night <br />entertainment recently and was unsure what local ordinances pertain to this activity. He advised <br />there is an Antique car show on Thursday evenings, and he understood the concerns of the <br />,. abutting neighbors and will address those problems. Mr. Tallon questioned:if antique car shows <br />were part of the store policy. Mr. Simms coufirmed this is not a store policy but merely a <br />decision that was made by local management at Bakers Square. Mr. Buckendahl noted it is not <br />only an antique car show, but there is a lot of ra$ling on Thursday evenings. Councilman McKay <br />advised the residents to call the police department if there is a noise problem. He further stated, <br />that council has taken a position in the past prohibiting neon lighting where a property abuts a <br />residential area. Although there is not a code prohibiting neon, Mr. McKay did not believe it was <br />necessary. Mr. Forester advised the neon does not abut the residential areas. Mr. Tallon noted <br />there is a grass cutting ordinance and if the grass gets too long it should be reported to city hall as <br />the property owner could be cited for violating the property maintenance code. In reviewing the <br />site plan, Mr. Forester explaiued the parking lot extends to within three feet of the southern <br />property line. He did not believe the maintenance problem concerned this property. A resident <br />argued it was part of Bakers Square property as he was advised by one of their representatives <br />that the property extended all the way back to the street. Mr. Forester volunteered to pull out the <br />record outlining the survey for the Bakers Square property, and if the boundaries were not clear <br />he would have it re-suxveyed. Mr. Demeter stated he would not have been notified of this <br />meeting ifhis property did not abut Bakers Square Properiy, therefore the maintenance issue must <br />be on Baker's Square Property. Mr. Forester will research this further and report on it at a later <br />date. Mr. Asseff questioned if the neon could be seen from any of the residential properties. Mr. <br />Forester reiterated the neon would not be visible from the residential property. Mr. Tallon stated <br />it (the neon) would probably be visible from the rear residential properties that abut on the east <br />side. He requested that the existing hedge row on the south corner of the property be continued <br />3
