ROLL CALL: <br />Vice Chairman Brennan called the meeting to order at 7:40 P.M. <br />Present: T. Brennan; R. Koeth; K O'Rourke; and W. Spalding. R. Tallon arrived late. <br />Absent: D. Cameron-Alston and S. Asseff. <br />Also Present: Building Commissioner Conway; Assistant City Engineer McDermott; Assistaut <br />Law Director Dubelko; and Clerk of Commissions Cornish. <br />U. REVIEW AND CORRECTION OF MINUTES: <br />R. Koeth moved to approve the minutes of Apri114, 1998, seconded by T. Brennan. Roll call on <br />motion: Koeth, yes; Brennan, yes; O'Rourke, yes; and Spalding, abstained. Motion carried. <br />R. Koeth moved to approve the minutes of Apri128, 1998, seconded by K. O'Rourke. BUII.DING DEPARTMENT REQUESTS: <br />A) Shirmer Construction, 31350 Industrial Parkwav. <br />Proposal to construct office/warehouse which will include covered storage, a recessed truck <br />dock, a shed, and lot renovations. To be heard by board of zoning appeaLs May 7, 1998. Heard <br />by Planning commission March 24, 1998 and architectural review board Apri115, 1998. <br />Mr. Cerny, architect presented the proposaL He noted in the meeting with architectural review <br />board changes were requested to the landscaping plan. The revised landscape plan, dated May <br />11, 1998 was reviewed and approved by the Chairman of the Architectural Review Board. Mr. <br />Cerny noted he recently received a copy of a memorandum from the City Forester which <br />suggests changes to the overall landscape plan that is contrary to what architectural review board <br />already approved. H'is main concem was eliminating the mounds along the North and East <br />property lines as requested in the foresters memorandum of May 11, 1998. Mr. Cemy explained <br />when this proposal was presented it was highly recommended that some landscape buffering be <br />constructed across the back which was to include mounding and the evergreen trees. The <br />owners of the property appreciated the opportunity to enhance the appearance of their properiy <br />and at this time do not wish to leave the existing mess along the back of the property. Mr. Cerny <br />stated he believed he could convince the city forester to accept this proposal, and questioned if <br />the commission would consider approving the proposal pend.ing the foresters approval for the <br />removal ofthe trees. Assistant Law Director Dubelko was unsure that the tree ordinance applies <br />to Industrial Property, however assu.ming that it does apply, the way it is set up is that if planuing <br />commission approves a landscape plan the permit must be issued. Mr. Dubelko did not believe <br />the City Forester has any discretion as far as the removal of trees if the planuing commission <br />approves of the landscaping plan. W. Brennan questioned if the plan approved by architectural <br />review board included the mounding, and Build.ing Commissioner Conway announced that the <br />May 11, 1998 plan does include the mounding across the back. It was noted the architectural <br />review board chairmun did have a copy of the foresters memo when he reviewed the May 11, <br />1998 plan. Mr. Brennan announced the city forester should have the.right to come out and look
