If they are not witlun <br />code the building department can then tell them what they need to do to either bring it into code or <br />how to address getting a variance. Mr. Maloney suggested the board has become a victim as well as <br />you the owners are victims. No further questions were asked. <br />T. Request a 10 foot setback variance for patio. <br />Violation of Ord. 90-125, Section 1135.08 (a). <br />Chainnan Gomersall called all interested parties before the board. The oath was administered to BoU <br />Vale, and Mr. Swiercinski. Mr. Gomersall reviewed the variance request. Mr. Vale suggested Mrs. <br />Reynolds has a patio there now with an alu.minum awuuig, we are going to remove the awuing and <br />replace it with a wood roo£ We will not be doing any ceinent work. Mr. Krei-nzar asked about a <br />footer. Mr. Vale indicated we are not.sure if there is a footer or uot as the patio was done by <br />someone else. Mr. Swiercinski suggested neither coutractor kuew if a footer was in place and <br />wouldn't laiow until they start their work. Mr. Goinersall iudicated the contractors better make dam <br />sure there is a footer aud if there is not to address that matter with the owuer before you go on. Mr. <br />Vale suggested they would make sure there was a footer.. No further questions were asked <br />J. ' Request a 99 square foot variance for lot coverage iu excess of the <br />750 square foot maximum permitted for a combination of detached and attached garage. Violatiou <br />of Ord. 90-125, Section 1135.02 (o-3). Note: Existing attached garage is 273 square feet and the <br />proposed detached garage is 576 square feet. <br />Chairman Gomersall called all interested parties before the board. Mr. Kremzar asked about the view <br />comiug out of the driveway, will there be euougli clearance to get out of your driveway safely. Mr. <br />Shaip suggested the clearauce was taken iuto cousideratiou when the driveway was desigued_ We <br />have given this plan a lot of thought. Mr. Gomersall asked don't you tlvnk it is dangerous putting <br />your driveway onto Columbia Road. Mr. Sharp indicated he has had problems trying to come out of <br />his driveway onto Buttemut, in fact I had an accident and I was found at fault. The traffic on <br />Butternut is so bad i feel this is the lesser of two evils. I'm concerned for my parents, and lcids. Mr. <br />Gomersall implied you may or may not need to get permission from the state to put this curb cut in. <br />Mr. Conway suggested the plans have been sent to the Engineering department and I have not <br />received a response from them yet. You may have to deal with the state. The drawings have beeu <br />sent to all party's that need to look at it, and Mr. Sharp will be notified of their finding.
