Mr. <br />Kula indicated that would be fine, and all he was trying to do was keep competitive with the other <br />10 car dealers that are listed that have more lighting then what he is asking for. Mr. Koeth <br />suggested Mr. Kula did a good job comparing, but the commission has to look at each dealership <br />individually to consider what is surrounding each of them. In this situation you are unique in that <br />there is no building that will be blocking the light from the residents. This dealership is also closer <br />to residents then most of the other ones. He doesn't believe the board can compare this <br />dealership with the other ones. The Planning Commission does not group all dealers together <br />they are each considered individually, you can have the comparison but the board can not use it <br />for it's decision. Mr. Conway commented that the comparison did not list the wattage that is <br />used by the other dealers either, the comparison had relevance to it but would be hard ta make a <br />real comparison. Mr. Koeth indicated Mr. Conway was correct and he agreed with Mr. <br />Dubelko's statement. Mr. Brennan asked if with the development of the historical area would <br />there be an: ordinance pertaining to lighting City wide. Mr. Dubelko commented that there was a <br />pending ordinance pertaining to lighting five or six years ago to revise both the criminal code and <br />the zoning code, but it died in committee some were. It is something Council should look at <br />aaain, not only because of the historical site, but because it is a subject that comes up all the time. <br />The cocle currently places the obligation on the Planning Commission to make sure the lighting <br />that is put up does not cause "glare" or "excessive brightness to neighbors", and that it will not <br />have an adverse affec* on any adjoining residential districts. It would serve the City to have a <br />better ordinance in the books. Mr. Brennan reviewed what the differences were between active <br />and inactive lots and commented that, the problem is a car dealership basically has their products <br />outside and most people look at cars in the evenings. NIr: Spalding asked if shielding could help <br />control the lightina properly. Mr. Brennan suggested there were a couple of issues present with <br />redeveloping, they could scatter a couple of pole lights on a second row, but would they have to <br />be removed if redeveloped. He commented that Mr. Dubelko had an excellent point with the <br />historical district, they do malce historical lights with somewhat colonial appearance. There are a <br />lot of zeasons why they should be given lighting and a lot of reasons why they should hold off on <br />putting lights in right now. Mr. Spalding suggested the proposal should come back when the <br />chairman is present. 1VTi-. Brennan indicated he would like to open the floor to the residents. Dr. <br />christen Smith-Dorey indicated she lived in the Sth house on the West Side of Dewey and <br />indicated she had a vested interest in the issue. She indicated the motto of the City was "Together <br />We Can Make a Difference", well the residents on Dewey live that motto. Eight residents out of <br />the siYteen homes are present. She questioned if the industry standards were for large or small <br />dealerships and commented that she could point out other small dealerships that don't have the <br />amount of lighting Halleen is proposing. She indicated that reference had been made to trees on <br />the empty lot but pointed out that the lots were owned by Halleen and could be cut down at any <br />time. Trees only have leaves on them in the summer months, so they would not block out the <br />light in the winter and with snow on the ground it would only heighten the glare. She concurred <br />with the historical planning of the corner of the street and the residents would like to see the <br />historical area expand. Dr. Dorey indicated she was glad to hear that there was an active <br />historical society in place and would like to volunteer her services. She commented that Halleen <br />had a history of not keeping their word to the residents. As an example; there was a sign that was <br />not to code and Halleen had purchased partners bar and promised to landscape and place <br />4
