Spalding questioned if a daycare was located on the same property, could a bar get their liquor <br />license. Mr. Dubelko suggested it would be up to the State to make the ruling, as he understands <br />Mr. Gareaus ruling. Mr. Conway reviewed that slam jams had a similar problem and the daycare <br />was right next store and it was determined that the daycare was not a true school. Mr. Spalding <br />suggested he did not think the ruling would be the same with both facilities on the same lot. Mr. <br />Dubelko suggested the City would be hard pressed placing a zoning code limitation, which would <br />dictate that the State could not grant a liquor license to a facility close to the daycare. It is up to <br />the State to determine that. Mrs. O'Rourke again questioned how many kids would be in the <br />building. Mr. Mongello indicated by law they are allowed to serve 48 children. Mr. Tallon asked <br />how the children would be dropped off each day. Ms. Marinescu suggested the children that are <br />cared for in the building are of an age that a parent would have to bring the child into the building. <br />Mrs. O'Rourke questioned what age group of children would attend the daycare. Ms. Marinescu <br />suggested the age would range from 6 weeks to 5 years old. Mr. Tallon indicated most parents <br />would be dropping their children off on their way to work. Which suggests to him the traffic <br />would be very heavy. He asked how the developer planned on parking 48 cars. Ms. Marinescu <br />indicated the children are dropped off at different times and most cars are only there for about 5 <br />minutes at a time. Mr. Hreha asked how many parking spaces would be in front of the building. <br />Ms. O'Rourke indicated there would be a total of 20 parking spaces, and one handy cap has been <br />eliminated. NIr. Tallon asked if the handy cap ramp would be on the same side of the building as <br />the handy cap parking space. Mr. Mongello indicated Mr. Tallon was correct. Mr. Tallon asked <br />how many teachers would be employed. Ms. Marinescu suggested there would be 6 teachers <br />including her. Mrs. O'Rourke reviewed the teacher ratio differed depending on the age of the <br />child. Mr. Brennan asked Mr. Conway if the conditional use was needed, because of what the <br />building would be use for. This is daycare orientated in a general business district. Mr. Conway <br />suggested Mr. Brennan was correct, and indicated the standards were less in a general business <br />use then in retail. Mr. Tallon suggested speed bumps be added in the front of the daycare. Mr. <br />Spalding asked about the landscaping. Mr. Mongello suggested the landscaping had been <br />approved at an earlier date. Mr. Brennan suggested a sidewalk should be added that goes up to <br />the Lorain Road entrance. Mr. Mongello indicated the side area was were the utilities would be <br />located, and it was also considered the 10'foot sideyard setback. Mrs. O'Rourke asked if <br />pedestrians would have to walk along the grassy area to get to the building. Mr. Mongello <br />suggested pedestrians would have to walk in the parking lot to get to the daycare. Mr. Tallon <br />suggested even though this is an old proposal he indicated a sidewalk should be placed along the <br />grassy area. Mr. Conway suggested if the Planning Commission allowed the proposal, the <br />building department could send them to the Board of Zoning Appeals board for a variance <br />without having to return to this board again. Mr. Mongello asked if they would have to go for a <br />variance for the sidewalk. Mr. Conway indicated the plans that were approved call for a <br />landscaped area. Mr. Tallon indicated the board would want it footnoted that it is because it is a <br />change of use from the approved proposal. Ms. Kopko asked if the board wanted the sidewalk <br />started directly across from the front doors of the daycare. Mr. Tallon indicated she was correct <br />and that a crosswalk made of yellow hash marks should also be added. NIr. Brennan suggested <br />speed bumps also be placed on either side of the crosswalk. Mr. Mongello asked how wide of a <br />sidewalk should be put in place. Mr. Conway suggested a sidewalk is 5 feet wide for two people <br />to walk side by side. Ms. Kopko suggested there were trees that would be shifted as there was a <br />concern that the tree's roots would lift the sidewalk. Mr. Spalding asked if there were lights along <br />that side of the site. Ms. Kopko indicated there were lights along that area. She asked if the <br />daycare was approved the conditional use permit, would the tenant have to reapply every year. <br />! <br /> <br />2
