Since the Dealerslup is already there tlus should <br />not cause any increase in traffic, nor would it be a health, safety or welfare hazard to the <br />neighborhood. Mr. Tallon aslced Mr. Murray if Nir. Hill would remain on the property? Mr. <br />Murray indicated that Mr. Hill Sr. had trausferred his property over to his family and to his <br />knowledge he would remain on the properry. Mr. Tallon then questioned if the Hill family was <br />asking the comlnissioners to rezone the properiy and would they still retain ownership of the lot? <br />Mr. Murray inclicated the Hill family wanted only the back portion of the property rezoned. Mr. <br />Tallon also questioued why ou the oiigiual sheet giveu to the commissioners parcel #232-10-050 <br />was the only lot iu question. Mr. Murray indicated ou the first submittal they had asked to rezone <br />50' feet by 148' feet aud when the deed was transferred they found it was actually 100' feet x <br />148' feet. They amended that submittal, sent a new map and a new list of surrou.nding neighbors. <br />Mr. T'allon indicated what was being asked was uot in everyone's best interest and didu't go along <br />with the City's Master Plan. T'hey don't graut lot splits and try to correct them whenever <br />possible. To wluch N1r. Mun•ay replied it would be in Mr. Hills best interest and since the lots <br />already have Uusiness zoniug to the East they felt perhaps Mr. Hills property could be rezoned. <br />Mr. Brennen indicated the people don't want resideutial property rezoned to commercial. Dean <br />McKay councilmau for ward 4, indicated the reasou for any rezoning is not based on anyone <br />making money. We have a lot of problems with split lots in this city. Mr. Meadows a resident <br />that lives on Porter Road, questioned, besides the Motor Car Dealership who would want to buy <br />Mr. Hills property if the rezouing was allowed to take place? There is a lot of noise at the car <br />dealership now because of the ringing phones and he had counted 75 phone calls on a holiday. <br />Mr. Tallon suggested 1Vh-. Meadows call the buildiug department and have them check the decibel <br />level. Mr. Meadows iudicated he was not happy about the parking lot lighting but he couldn't <br />really complain since the dealerslup was ah-eady there when he bought his property. Mr. Koeth <br />then questioued if Mrs. Frank the abutting property owuer was in the audience. Mr. Hoelter, a <br />neighbor aud long tune resident of North Olmsted, indicated Mrs. Frank was in the audience and <br />was uucomfortable about speaking so he would speak on her behalf. Mr. Hoelter indicated Nirs. <br />Frank was totally against the rezouing. Mr. Hoelter told the commissioners the car dealership had <br />already owued property and sold off 100' feet by 1272'feet deep and 100'feet wide by 1485' feet <br />deep. They had a trailer ou theu- used car lot before and they could put that trailer where it was <br />previously. Mr. Hoelter cited Parma as a city that has a residential raiding code, which is <br />cominercial property tliat is divided up and wheu the commercial properties over grow their <br />usefulness or over extend themselves they raid the residential areas. He would not like to see this <br />happen to his ueighborhood. Nlr. Pau1 Miller, couucilman at large came forward to speak. He <br />indicated that he shopped at the dealerslup, was very happy with the treatment he received and <br />would recoimnend them to other people. But we need to look at the long range plan and realize <br />the property iu the future may be used for a bodyshop or quick oil change which would add more <br />traffic to the area. T1us neighborhood has ah-eady had enough expansion. Maybe they could <br />look for altemative answers. To the iuunediate West is the car wash and maybe they could <br />ptuchase land fiom them, as it is ah-eady zoned for what they need. Don't talk to the residents <br />about auy offering of a deed restriction as they have ah-eady had experience with that. <br />Mr. Dubelko, Assistant Law Director iudicated he would like to comment on a couple of items <br />fiom the law department. Fu•st about the Planning Commissions function here. Since this is a <br />rezouing request, there are two mnethods in the North Ohnsted zoning code for rezoning property. <br />2
