CITY OF NORTH OL1VdSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - SEPTEMBER 16, 1999 <br />1. ROLL CALL: <br />Chairman, Burk called the meeting to order at 7:50pm. <br />PRESENT: Chairman, R. Burk, Members, C. Engoglia, and D. Spoerke. <br />ALSO PRESENT: Clerk of Commissions, D. Rote. <br />ABSENT: Board member, J. Kazak <br />II. REVIEW AND CORRECTIONS OF MINUTES: The minutes of the October 22, 1998 Board of building code <br />appeals meeting were submitted for approval. <br />C. Engoglia motioned to approve the minutes of October 22, 1998. The motion was seconded by D. Spoerke and <br />unanimously approved. <br />III. COMMiJNICATIONS: No items <br />IV. HEARINGS: No items <br />V. NEW BUSINESS: <br />1) Latina & Latina Builders- 3442 Bridgeport: <br />Request a variance to be pernutted to leave basement ceiling by beam at 6 foot 2 inches. <br />A 2-inch height variance for basement ceiling height by the beam is required. <br />OBOA Section 305.1 Exc # 3. Minunum ceiling height under basement beam is to be 64"; applicant <br />is at 6' 2". <br />Chairman Burk reviewed the request and asked that all interested parties come forward. Mr. Balsamo,,from <br />Latina & Latina came forward to review the request. Mr. Balsamo indicated that the home was not one of <br />Latina's model homes. It is called a designed basic that the customer requested Latina & Latina build. The <br />Latina's built the home by the spec and didn't know that the beam was an 11 inch beam instead of the normal <br />8-inch beam.. That is why there is a 2-inch shortage in the ceiling. He indicated that Mr. Engoglia was <br />correct that the size of the beam is overkill and the engineer didn't notice the mistake until it was to late. He <br />indicated that he had spoken to Mr. & Mrs. Farmer the buyers as they had noticed it before he did as they <br />brought it to his attention. Mr. Latina was made aware of the problem and contacted the building department <br />to find out what needed to be done. The owners do not have any objections to the variance request. The <br />house will not be built again as it was plans that were submitted hy the homeowner. Mr. Balsamo assured the <br />board that the mistake would not happen again. Mr. Burk commented that the board received a letter from <br />the Building Commissioner who would be unable to attend the meeting. He read allowed the letter that was <br />received. (Note: A copy of the letter received is attached to the back of these minutes). Mr. Burk indicated <br />that the board was given an assurance that the mistake would not be repeated as it was not the typical home <br />built by Latina & Latina, and it would not be repeated. Mr. Burk indicated that the board would like to have a <br />copy of a letter written by Latina & Latina to the owners, Mr. & Mrs. Farmer and have the letter signed by <br />the Farmers, then returned to the City of North Olmsted for the street file. Mr. Engoglia indicated that he <br />visited the site and it was just the beam needing the variance as the distance from the ceiling to the floor- <br />measured 7' 1". The ceiling height is not wrong it i's only the beam that is to low. .
