ROLL CALL: <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, R. Gomersall, Commissioners, J. Maloney, J. Konold, and W. Kremzar and T. <br />Koberna. ALSO PRESENT: Law Director, M. Gareau, Building Commissioner, D. Conway, and Clerk of <br />Commissions, D. Rote. <br />II. DISPOSTTION OF MINUTES: J. Konold moved to approve the February 4, 1999 minutes as written. The <br />motion was seconded by, J. Maloney, and unanimously approved. Motion Carried. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />1. Oakleaf Furniture23789 Lorain Road: <br />Request for variance (1123.12). Proposal consists of; Interior & exterior alterations, and building addition. <br />A special permit to add to a non-conforming building will be required. <br />Tlie following variaiices are requestod: <br />1) A special permit to add to a non-conforming building (1165.02) <br />2) A 2' foot front yard setback variance (75'feet required). (1139.07) <br />3) A 25' foot rear yard setback variance (25' feet required). (1139.07) <br />4) A 9' foot front parking setback variance (20' feet required). (1139.07) <br />5) A 34' foot side yard setback variance (50' feet required). (1139.08) <br />6) A 20' foot side drive setback variance (20' feet required). (1139.08) <br />7) A variance NOT to have a truck loadinghinloading area (12' x 25' required) (1161.03). <br />8) A variance for excessive land coverage (code allows 25%, they have 35%) (1139.05). <br />9) A variance for 1 car parking (18 req'd, they have 17 plus 2 non-conforming spaces) (1161.05) <br />10) An 8" inch height variance for wall sign (4' foot allowed, they have 4'. 8") (1163.12). <br />11) A 13 square foot variance for wall sign (75' sq. ft. allowed they have 88' sq. ft.) (1163.12). <br />Which is in Violation of Ord. 90-125, Sections (1165.02), (1139.07), (1139.08), (1161.03 & 05), <br />(1139.05) and (1163.12). <br />Chairman Gomersall called all interested parties forward and reviewed the variances being requested. <br />Mr. Hershcman, from Hershcman Architects came forward to represent Oakleaf Furniture. 1V1r. <br />Gomersall suggested since there were so many variances being requested, he would like Mr. Hershcman <br />to review each of them. Mr. Hershcman suggested his company had been before the Board of Zoning <br />Appeals in 1997 for the same building. At that time the company seeking the variances was Forest City <br />Auto Parts. The present building is a non-conforming building, the plan is to square the building of£ The <br />parking area will be reworked, and a ground sign has been removed. The owner would like to redesign <br />the building to be used in today's market. Mr. Gomersall reviewed that the building was grandfathered in <br />for the previous tenants. Mr. Hershcman suggested he understood their proposal was a separate issue. <br />There is quite a list of variances, but they all are to benefit the existing building. There will be a new <br />addition around the entire existing building, when it is done in essence it will be a new building, which <br />will be an improvement. The variances such as they are, are needed because of the existing building. <br />For the most part the variances being requested are to improve the existing building, in terms of its use <br />and the type of user that will be occupying the building.
