variances. On December 3, 1997, 18 lots received 5'foot rear yard variances, and at that time the Latina's <br />indicated there may be 3 more rear yard variances needed. Latina & Latina returned before the Board of <br />Zoning Appeals on February 11, 1998, and instead of requesting 3 variances, they requested 16 additional <br />rear yard variances. Mr. Puper a former member of the Board of Zoning Appeals expressed his concern <br />about people asking for variances and then coming back a month later requesting the same variances. Mr. <br />Puper further questioned Mr. Latina if he would be returning the next month requesting additional <br />variances, if that evenings variaiices being requested were approved. In the minutes Mr. Latina stated " <br />he assured the board they would not be back requesting additional variances. Councilman, M. Gareau Jr. <br />suggested Mr. Latina's response would be on that lot or these lots. Councilman, M. Gareau Jr. stated " <br />There has to come a time when these developers are made to build homes that fit the lots they are being <br />built on". He further suggested the sizes of the lots and homes had been assigned when the property was <br />purchased, and now the situation is they are adjusting the property to fit the homes. He objects to <br />adjusting the property to fit the home, and feels a line should be drawn aiid the developers should be told <br />enough is enough. Councilman Miller indicated that he sat on the Board of Zonuig Appeals board when <br />some of the earlier variances were requested by Latina & Latina, and at that time he indicated they were <br />trying to fit to big of homes on to small of a lots. It has been a consistent problem with this developer that <br />they are trying to over build, and when you are looking at a 2'foot variance it doesn't seem like much, but <br />when you take into consideration a total of only 15'feet between the homes 2'feet is a lot. Councilman <br />Miller asks the Board members to consider that fact when rendering their vote. Chairman Gomersall <br />swore in Mss. Hoy, and Mr. Ziemianski the potential home owner. Mss. Hoy suggested if the issue is to <br />move the house 2' feet to the east she doesn't have an issue with that at all. She indicated she had been a <br />resident of North Olmsted for 10 years, and have children in North Olmsted schools, and would like to <br />build their new home on this lot. She suggested if the Board members allowed the developers to build <br />their proposed home 2'feet to the east without impacting the neighbors it would solve the issue. Mr. <br />Ziemianski suggested he echoed the opinion of his fiance. Mr. Balsamo suggested they are not building <br />the homes to big for the existing lots, Miss Hoy & Mr. Ziemianski have chosen a home designed for the <br />lot size, it is because of the home to the west of their lot that the variance is needed. So don't suggest they <br />are cramming the homes on the lots. Mr. Gomersall suggested the developers cramming the homes on the <br />lots, they have needed variances for fronts, backs, side yards, at least dlree times. No further questions <br />were asked. <br />W. Kremzar motioned to approve Latina & Latina, of 23232 Bridgeport Drive, their request for variance <br />(1123.12). Proposal to construct a single family dwelling and the following variance be granted. <br />A 2' foot side yard variance. (code requires 15'foot side yard, proposed dwelling will be 13' feet). Which <br />is in Violation of Ord. 90-125, Section 1135.07(a). The motion was seconded by, J. Konold. Role call on <br />die motion: W. Kremzar; No, J. Konold; Yes, J. Maloney; No, and R. Gomersall; No. Variance Denied. <br />Mr. Balsamo asked if both home owners agreed to move the home 2'feet to the east would that be <br />expectable, as the board has indicated they are tired of seeing us here. Mr. Gomersall clarified that the <br />board is tvred of all the variances being requested for this development nothing more. Mr. Balsamo asked <br />if a variance would be required if the house was moved 2'feet to the left, and if it does could it be voted <br />on tonight instead of waiting a month. Mr. Gomersall suggested we are not here to solve your problems <br />and the issue was not brought up until Mr. Wright brought it up tonight. Mr. Conway indicated a variance <br />would bee needed for the 25'foot required setback, and it would be a sideyard setback for a corner lot, not <br />a sideyard between residents. Mr. Gomersall suggested every board member prior to this meeting <br />discussed and thought moving the house 2'feet east would be appropriate, but the developers never <br />entertained it or brought it up. Mss. Hoy asked Chairman Gomersall to please allow her potential home to <br />be moved 2'feet to the east. <br />R. Gomersall moved to reconsider the earlier motion made on Latina & Latina, 23232 Bridgeport Drive. <br />The motion was seconded by, J. Konold. In the framing of the motion to reconsider Councilman M. <br />Gareau Jr. stepped forward and indicated he had spoke to all of the residents that were present. There <br />could be a bit of a problem moving the home 2'feet to the east corner, as the residents across the street <br />10
