Mr. Gomersall suggested Mr. Minadeo stick to issues pertaining to <br />the variances being requested. Mr. Minadeo became very argumentative as well as other residents, and <br />would not come to order when asked by Mr. Gomersall to do so. Law Director Gareau came forward and <br />stated " If Mr. Minadeo and other residents continued to carry on as they have, they are in violation of the <br />City Code dealing with order at a public meeting, he will go to a phone, call the police and have them <br />removed. You retain order and respect the Chairman". At this point Mr. Minadeo stated "He does <br />respect the Chairman but, the board doesn't respect us. Law Director Gareau stated " you are yelling and <br />screaming", again Mr. Minadeo interrupted Law Director Gareau and became argumentative. Law <br />Director Gareau stated " I represent this board and the City if you have a question about your own private <br />rights you should seek them out through a lawyer. Don't come here screaming and yelling disrupting a <br />ineeting, and if you continue to do so I will call the police and have you removed". Mr. Minadeo <br />suggested he respected the board, but indicated he is concerned. Mr. Gomersall suggested moving on. <br />Nlrs. Brown asked what a non-conformulg building was. Mr. Gomersall indicated it means it doesn't <br />comply with today's requirements. Mr. Shirkey suggested when the church was built the code required a <br />50' foot setback but, today the setback is set at 75' feet. Which would not allow the church to continue <br />the ]ine that has been set. In cases were an existing building is out of code they are granted a special <br />permit to continue the building along die set luie. The variance on parking is for the parking that will face <br />Great Northern Blvd. only. Mr. Minadeo suggested the church will be only 25' feet from his house. Mr. <br />Shirkey reviewed the sign request. Councilman McKay indicated if we don't stick to the zoning code <br />what good are they. He understands there are hardships, but these people understood the zoning code <br />when they bought this lot, because they haven't been there that long. The church is proposing to add as <br />much non-conforming as to what there is presently. He doesn't feel it is correct to allow the variances. <br />Mr. Lavelle suggested when he asked Mr. Shirkey earlier about the drainage he indicated it would be <br />dumped to the south, and asked if the storm would drain to the south end ditch. Mr. Shirkey indicated <br />they would comply to the City requirements. Mr. Lavelle suggested before the board vote on anything <br />dley need to find out about the drainage issue. Mr. Conway indicated drainage is not germane to this <br />board. Mr. Conway further suggested drainage would be addressed at the Planning Commission meetulg <br />that the church will attend. Mr. Lavelle asked the pastor if the new addition would be used as a party <br />center. Pastor Schultz indicated it was not the intent of the church to rent the hall out to just anyone. The <br />vision of the church it to become a youth center and help the community as much as they can. He feels <br />there has not been enough said of the good that a church does for a community. Pastor Schultz suggested <br />he felt God has placed his church in this area. Mrs. Brown again reviewed water drainage, and suggested <br />diverting the water into the 480 sewer system or somethuig along that area. Mr. Brown asked where the <br />air conditioning units would be located. Mr. Shirkey suggested tllere would be air conditioners on the <br />ground along the front, and some in the back which will be surrounded with six foot high colonial <br />stockade fences. Mrs. Brown indicated she was concerned about the cross next to the sign as it shines into <br />her home. Mr. Shirkey indicated the cross would not be raised just the sign itself would be raised 5' feet. <br />Mrs. Brown indicated she doesn't think the sign should be raised 10'feet. Mr. Gomersall asked Pastor <br />Schultz if the cross was lit at night. Pastor Schultz indicated the cross would not be raised and believed <br />the north addition wauld block the sign that presently shines into IVIrs. Browns home. Mr. Gomersall <br />suggested to Mrs. Brown that he believed the new addition would block the sign. Mr. Minadeo indicated <br />that it is all well and good that the church wants to be a good neighbor now but in the past it was out of <br />site out of mind. He would also like the board members to come out to the site and look it over. Mr. <br />Gomersall assured Mr. Minadeo that each of the board members had been to the site and looked it over <br />before this meeting ever took place. Mr. Minadeo indicated he didn't believe dlat the board members <br />were ever at the site. The clerk announced that the North Olmsted Evangelical Friends church will attend <br />the Architectural Review Board meetuig on 2/17/99; at 5:30 p.m., and will go before the Plannuig <br />Commission on 2/23/99; at 7:30 p.m.. The clerk also amiounced no further notices would be sent out. <br />Mrs. Brown asked if the City had a web site. The clerk suggested she believed the web site address is <br />Northolmsted.com, and if Mrs. Brown called her at her office she would get the web address for her. Mr. <br />Gareau Jr. came forward and advised caution on using the North Olmsted web site as there have been up- <br />dating problems in the past, so residents should not relay on what is on the web site, and to call City Hall <br />5
