treat it as any other signage. What the applicants want to do is say that they aren't even going to <br />treat it as signage and they are goina to wait until the court makes a ruling. Ms. 7arvis reiterated <br />that when she talked to the Building Department they talked about it in depth, but didn't explain it <br />to her the same way as Mr. Gareau just did. She indicated that she understood it all now and <br />would figure out the square footage. She suggested that the owners would probably take it <br />down, but would have to move it due to the Code changes and there would be a lot of expense <br />involved. Mr. Gomersall questioned what the total signage requested and what is allowed. Mr. <br />Rymarczyk responded that the applicants are allowed a total of 104 feet of signage. Mr. <br />' Gomersall indicated that the applicants pole sign is 40 square feet, the wall sign is 32 square feet <br />and an additional wall sign of 32 square feet totals what they want to put in place. Everyone <br />agreed there would be no signage on the north side. Ms. Jarvis indicated that the small sign for <br />the drive-throujh would be removed. At this point, there was a discussion over square footage <br />allowed and not allowed for this business. NIr. Gomersall suggested that the applicants needed <br />approval for a logo and a variance of 40 square feet. Ms. Jarvis questioned if the owner agrees <br />. and the Board approves, can she reface the pole sign. Mr. Gomersall commented that yes, it <br />would be the third variance, to reface the pole sign. <br />J. Maloney motioned to grant Yummy Kitchen of 26625 Brookpark Road their request for variance <br />(1123.12), as amended and agreed upon. Proposal consists of a sign package, and that the <br />following variances be granted: <br />1. An additional wall sign on the west side of building that will be 32 sq. ft(code permits 1, <br />applicant requests 2), section (1163.12 A) <br />2. A variance to permit a logo on the south side of building (1163.12 A), (1163.16 D) <br />3. A variance to allow applicants to reface the existing pole sign (1163.22). <br />The motion was seconded by T. Koberna and unanimously approved. Variance Granted. <br />IV. COMMUNICATIONS: <br />A letter was submitted by J. Maloney, pertaining to the City Codified ordinance (1135.02), <br />paragraph D, Item 2. In which the total area of a detached garage, accessory storage building or <br />other accessory structure, such as a deck, swimming pool, should not exceeds more than 20% of <br />the required area of the rear yard on which such building or structures are located. He would like <br />the Chairman to recommend that Council review aboveground swiinming pools. Note: Said letter <br />is attached to the back of these minutes. <br />J. Maloney motioned to have council review the submitted letter. The motion was seconded by T. <br />Konold and unanimously approved. <br />J. Konold motion to elect R. Gomersall as Chairman. The motion was unanimously approved. <br />R. Gomersall motion to make J. Maloney Vice Chairman. The motion was unanimously <br />approved. <br />T. Rymarczyk questioned if the chairman would like to have a meeting on the 20th of January <br />instead of February. Mr. Gomersall indicated that he would not have a meeting in Jan. The first <br />meeting of 2000 will be the first Thursday of February. <br />11
