ROLL CALL: <br />Chairman, Maloney called the meeting to order at 7:30pm. <br />PRESENT: Chairman, J. Maloney, Board Members, J. Konold, T. Koberna and W. Kremzar. <br />ALSO PRESENT: Asst. Building Commissioner, T. Rymarczyk and Clerk of Commissions, D. <br />Rote. ' - II. REVIEW AND CORRECTION OF MINiJTES: The Board of Zoning Appeals minutes of <br />September 7, 2000 have been submitted for review. <br />J. Konold motioned to approve the Board of Zoning Appeals minutes dated September 7, 2000 as <br />submitted. The motion was seconded by W. Kremzax and unanimously approved. <br />Ghairman, Maloney advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment <br />affecting properties and like situations elsewhere. He explained that it would take three <br />affirmative votes to approve a request. All permits and or variances granted may be picked up <br />Wednesday in the building department. III. BZJILDINGDEPARTMENT REQUESTS: _ <br />1. Carmella Buildt: 23493 Marion Rd. <br />Request for variance (1123.12). The proposal consists of a new garage. <br />The following variance is requested: <br />1) A 2 foot variance for garage side yard setback (code requires 5' applicant shows 3). ' <br />Which is in violation of Ord. 90-125, section 1135.02 D-4. <br />Chairman, Maloney called all interested parties forward to review the request. The oath was <br />administered to Mrs. Buildt, the homeowner and 1V1rs. Haas, her daughter. Mrs. Buildt indicated <br />that the existing garage is 2-feet from the property line. She suggested that she had removed the <br />existing garage and was informed by the City that the current code requires a garage on the lot. <br />The current ordinance requires that the new garage will be S-feet from the side yard setback. <br />There is currently a very large oak tree in the way therefore, a variance is required. In addition, an <br />existing foundation which, is in good shape already exists. Mr. 1Vlaloney indicated that the <br />applicant would need to make sure that the drainage is addressed. Mr. Rymarczyk questioned if <br />the applicant was requesting, a 2-foot or 3-foot variance. Mrs. Haas indicated that the garage will <br />be 3-feet from the property line. W. Kremzar motioned to app'rove Carmella Buildt of 23493 Marion Road her request for variance <br />(1123.12). Which consists of a new'garage and that the following variance be granted: <br />1) A 2 foot variance for garage side yard setback (code requires 5' applicant shows 3'). <br />This is in violation of Ord. 90-125, section 1135.02 D-4. The motion was seconded by J. Konold <br />and unanimously approved. Variance Granted. . <br />2. Kimberley Botke, 28550 Holly Dr• <br />Request for variance (1123.12). The proposal consists of addition to attached garage. The <br />following variance is requested: <br />1) A 9 foot variance for front yard setback (code requires 50' applicant shows 41').
