J. Maloney motioned to approve Richard J. Rutt, 7r. of 24061 Mastick Rd. his <br />request for variance 1123.12. Which consists of construction of a new home. The <br />following variances are requested: <br />1. A 7.5 foot variance for minimum lot width (code requires 80 feet, applicant <br />shows 72.5 feet) section.1135.05 (a). <br />2, A variance for insufficient lot width, section 1165.04 <br />Which is in violation of Ord.. 90-125 sections 1135.05 (a) and 1165.04. The <br />motion was seconded by, W. Kremzar and unanimously approved. Variances <br />Granted. <br />8. Eric Hawkins; 3921 Eleanor Drive Request for variance 1123.12. The proposal consists of installation of a shed. The <br />following variances are requested: <br />1. A 61 square foot variance for overage in square foot allowed for a shed (code <br />permits 59 square foot, applicant shows 120 square foot) section 1135.02 <br />(d)(1), and - <br />2. A 5 foot variance for rear yard setback (code requires 10 feet, applicant shows <br />5 feet) section 1135.02 (d)(4) <br />Which are in violation of Ord. 90-125 sections 1135.02 (d)(1) and (d)(4). <br />Chairman Gomersall called all interested parties forward to review the variances <br />requested. The oath was adirunistered to Mr. & Mrs. Hawkins the owners who <br />came forward to review the request. Mr. Koberna questioned if the shed would be <br />built by the owners or a contractor. Mr. Hawkins indicated that they had <br />contracted a company from the Amish Country to build the shed. Mr. Maloney <br />commented that the applicants had plenty of trees to buffer the neighbors. No <br />further comments were made. <br />T. Koberna motioned to approye Eric Hawkins of 3921 Eleanor Drive his request <br />for variance 1123.12. Which consists of installation of a shed and that the <br />following variances be granted: <br />1. The proposal consists of erecting a patio enclosure. <br />The following variance is requested: A 9 foot variance for rear setback (code <br />requires 50 feet, applicant shows 41 foot) section 1135.08 (a). Which is in <br />violation of Ord. 90-125 section 1135.08(a). <br />7
