Koberna <br />ROLL CALL: <br />Chairman Gomersall called the meeting to order at 7:35• p.m. <br />PRESENT: Chairman Gomersall, Board Members J. Maloney, J. Konold, and W. Kremzar. <br />ALSO PRESENT: Law Director M. Gareau, Building Commissioner D. Conway, Clerk of <br />Commissions D. Rote, and Asst. Clerk of Commissions K. Fallon. <br />REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of December 2, <br />1999 have been submitted for review. <br />J. Konold inotioned to approve the minutes of December 2, 1999 as written. The motion was seconded <br />by W. Kremzar and unanimously approved. Chairman Gomersall advised that Board Members have viewed the premises involved and that each case <br />will be judged on the physical situation peculiar to itself, so that in no way is a judgement rendered to be a <br />?eneral policy judgement affecting properties and like situations elsewhere. <br />III. BUILDING DEPARTMENT REQUESTS: <br />Bob Anderson 29721 Westininster Dr. . <br />_ Request for variance (1123.12). Proposal consists of a new home. <br />The followulg varia.nce is requested: A 2.5 foot variance for rear yard setback, (code requires SOft, <br />applicant shows 47.5ft). Which is in violation of Ord. 90-125 section, (1135.08 A). <br />Mr. Gomersall called all interested parties forward to review the variance requested. Mark Leiden, from <br />Leiden Homes, Jim Batenchuck, from Caldwell Banker; and Thomas 0'Grady, Councilman at Large came <br />fonvard to review the request. Mr. Leiden indicated the lot had a utility easement that ran at an angle. <br />Because of the utility easement, the house had to be set back fiirther with a different design. The garage <br />needs to be placed in the front, which causes the rear setback violation. The applicant is asking for 2-1/2 <br />feet. Mr. O'Grady indicated there are several other homes that are affected by this water easement, so <br />there is precedence for granting this type of variance. Additionally, the home is designed to be wheel chair <br />accessible, with larger hallways and an eztra bedroom on the main floor. This extra bedroom on the main <br />floor causes the house to be forced farther back onto the lot. There is a need to be cautious with any kind <br />of variance, but with good solid justification, as presented to the Board, he strongly encourages the Board <br />to consider tliis variance favorably. Mr. Gomersall indicated that the request was very minimal and <br />questioned if there were any questions from the.,Board or audience members. No further comments were <br />made. <br />J.
