dangerous traffic situation so near to Rose Road, aesthetics, and maintenance and cost to the City <br />of North Olmsted, as well as the possible extension of Route 252. The motion was seconded by <br />K. O'Rourke and unanimously approved. At this time, Mr. Dubelko indicated that under the <br />Charter this proposal goes on to Board of Zoning and Development for their approval or denial. <br />At this time, the Clerk indicated the date for Board of Zoning and Development is on June 13, <br />2000 at 6:30pm. Motion carried. <br />3. Fairview Corporate Center Lot Split Plat; <br />The proposal is to split, at the North Olmsted / Fairview Corporation line, permanent parcel <br />numbers 237-23-023, 025, 037, 041 and 049, land located between Brookpark Rd. (north side) <br />and I-480 (south side), and extending eastward from Clague Road into the City of Fairview Park. <br />Zoning within North Olmsted is Multiple Residence Entirety. <br />Chairman Tallon called forward all interested parties to review the proposal. Mr. Lydon, from <br />Zaremba Management Services came forward to review the proposal. Mr. Lydon indicated that <br />recently in Fairview Park, the applicants have requested that the entire property include a small <br />portion of land in that is in North Olmsted. The applicants have recently been given the approval <br />of the City of Fairview to split the parcel into three lots within Fairview to develop an office park. <br />He indicated that as a course of action, the applicants have elected to create a fourth parcel of <br />land to encompass the land in North Olmsted. The applicants plan on building all of the <br />development in the City of Fairview with an exception of a. small amount of parking in North <br />Olmsted, assuming the Planning Commission allows the applicant to do so. Mr. Lydon indicated <br />that they have discussed the connection through the sanitary sewer on Clague Road as another <br />issue. Mr. Lydon indicated that the applicants do not have another alternative for this piece of <br />land, or how to treat it, other than the fact that they would like to create a separate parcel for the <br />purpose of easier tax assessing. He indicated that there would be some improvements, but this <br />piece would primarily remain green space. Mr. Lydon indicated that this parcel is impossible to <br />develop to create a new building structure on it and it is too inaccessible. He indicated that <br />ODOT has approved the curb cut onto Brookpark Road. Mrs. O'Rourke questioned if there was <br />presently a driveway. Mr. Lydon indicated that on the original plans there had been a curb cut on <br />Brookpark Road and going through the median, however, ODOT did not want to address that <br />due to traffic issues. He indicated that the property has alternate access onto W. 227"' Street, so <br />they did not feel the driveway was needed. Mr. Lydon indicated that the applicants would remove_ <br />the scrub and mound up the area to make a statement to create a very nice landscape entity. Mr. <br />Dubelko indicated that if this lot split is approved, the separate lot would legally become a <br />buildable lot. The use. requirements would have to give the applicant's the necessary variances to <br />build upon. Mr. Lydon questioned if a case could be made that there was no access from Clague <br />Road. Mr. Dubelko indicated that the City would have an obligation to give the owner access to <br />that lot. Mr. Dubelko indicated that the lot could be given to the City of North Olmsted as green <br />space and then the City would control it. Mr. Lydon indicated that he does not see a problem <br />with donating the space with the stipulation that Fairview Corporate Center would maintain it. <br />He indicated that he would consult with the applicant's law department. Mr. Tallon suggested the <br />applicant discussing this with the City of North Olmsted's Law Department, as well. Mr. Lydon <br />indicated that at this time he would withdraw the proposal. No further comments were made. <br />12
