Councilman Limpert suggested that he had <br />been listening to what was going on and indicated that eventually the ordinance will be in Councils lap -- <br />to decide. There are two problems he has been concerned with, the first being, that the City pass this <br />ordinance as is and the concern will be that it will not be tweaked, but just let the sleeping dog lye. <br />The second concern is that the City can not go without a sign ordinance. Good signs are not only in <br />the best interest of the residents they are also in the best interest of the business community. It <br />doesn't make sense for one business owner to, be responsible with good tasteful' signage and then <br />have another business owner to just put up an eye sore of a sign and without a sign code that- will <br />happen. Being on Council he doesn't think that 90 days would be enough time to get all the concerns <br />addressed. He would like to suggest that the ordinance get passed as is with a sunset clause of 6 <br />months to see if the City can come up with refinements that will benefit not orily the businesses but <br />the residents as well. He understands that Mr. Graham would like to see the changes made fast but <br />you can only make a horse run so fast and he is on Council and knows that 90 days is not enough <br />time to accomplish what needs to be done. <br />R. Tallon motioned to recommend to City Council Ordinance No. 2000-12 4 <br />An ordinance creating new and revised chapter 1163 of the Zoning Code of the City of North ? <br />Olmsted, entitled "SIGNS" as amended and to include the following inclusions: 6 <br />1) 1163.10 "Non-Conforming Signs" subsection (A) to read as follows; <br />(a) No non-conforming sign or part thereof.shall be altered, modified, or changed in any manner <br />whatsoever in any process of reconstruction, repair, or restoration, when the cost of said <br />reconstruction, repair, or restoration is more than 50% of the sign's replacement cost, unless the <br />entire sign shall be brought into compliance with all of the provisions_ of this Chapter, and all other <br />applicable City Laws. 2) 1163.10 "Non-Conforming Signs" subsection (B) to read as follows; <br />(b) Every non-conforming sign located upon a property, which undergoes a change of occupancy, <br />shall be brought into compliance with all of the provisions of this Chapter, and all other applicable <br />City Laws. <br />3) 1163.19 " Illuminated Signs" subsections (B) &( C) be stricken and (A) to read as follows; <br />(a) glare into or upon any residential property or into the right-of way. <br />4) 1163.26 "Ground Signs" subsection (B-5) to read as follows; <br />(5) If the vertical dimension of a ground sign is greater than the horizontal dimension, the sign shall <br />not exceed eight .(8) feet in height, measured from the street upon which the sign faces, or the ground <br />level where the sign is affixed, whichever is higher. <br />5) 1163.26 "Ground Signs" Subsection (6) is to be stricken in its entirety. <br />6) 1163.27 "Wall Signs" subsection (A) to read as follows; <br />(a) "wa11 sign" as regulated by this ordinance, shall mean all signs, which are attached to the exterior <br />front, rear, or sidewall of any building or other structure, or are painted directly on the wall or other <br />part of the structure. . . , <br />12.
